CRIMINAL LIABILITY REGIME FOR UNSPORTSMANLIKE BEHAVIOR: SOME CHALLENGES OF A CRIMINAL REGIME IN NEED OF EXPANSION

Dissertação de Mestrado em Direito apresentada à Faculdade de DireitoThe research that is now beginning intends to critically address the collection of norms that deal with unsportsmanlike phenomena in sport. We will highlight some features of the evolution of Sport, from its importance as a socioculturally aggregating practice to its aspect of economic exploitation and the resulting consequences. It is therefore necessary to rethink the protection of sport in the face of new phenomena and threats posed by globalization and technological advances, which have given a transnational dimension to this problem - which are in addition to the always relevant more traditional issues on this subject.We have analyzed some points of Law No 50/2007, of August 31, as well as rules of extravagant legislation that the legislator has been creating in an attempt to fight corruption and other phenomena that may jeopardize the legal good of truth, loyalty, and sports correctness. Despite the efforts made by the various players in the Portuguese legal system, and despite the fact that Portugal already has a solid set of rules on the subject, we believe that it is possible to go further: either through the clarification of the interpretation of the types of illicit already expressly enshrined in the legal diplomas, supported by an analysis of comparative law and the application of its norms by the jurisprudence, or by creating new mechanisms, taking into account the rapid adaptability of criminal agents to the repressive apparatus and the growing complexity of their behavior.A investigação que ora se inicia pretende abordar criticamente o acervo de normas que tratam fenómenos antidesportivos no desporto. Salientaremos alguns traços de evolução do Desporto, desde a sua valência como prática socioculturalmente agregadora até a uma sua vertente de exploração económica e as consequências daí decorrentes. Daqui resulta a necessidade de repensar a tutela do Desporto perante novos fenómenos e ameaças potenciadas pela globalização e avanços tecnológicos, que deram uma dimensão transnacional a esta problemática – que se juntam às sempre pertinentes questões mais tradicionais desta temática.Analisámos alguns pontos da Lei n.º 50/2007, de 31 de agosto, bem como normas de legislação extravagante que o legislador foi criando numa tentativa de luta contra a corrupção e contra outros fenómenos suscetíveis de pôr em causa o bem jurídico verdade, lealdade e correção desportivas. Apesar dos esforços levados pelos vários atores do ordenamento jurídico português, e, não obstante Portugal ser já detentor de um conjunto sólido de normas atinentes a esta temática, estamos em crer que é possível ir além: seja através da clarificação da interpretação dos tipos de ilícito já expressamente consagrados nos diplomas legais, apoiados numa análise de direito comparado e de aplicação das suas normas pela jurisprudência, seja através da criação de novos mecanismos, tendo em conta a rápida adaptabilidade dos agentes criminosos ao aparelho repressor e à crescente complexidade dos seus comportamentos
