The intergenerational dimension of environmental law: sustainability, equity and representation for future generations

Its goal is to understand in which way is it possible to promote the current representation of future generations’ interests in the scope of environment-relate decision-making proceedings. To this end, it seeks to properly determine the concept of future generations, in order to identify the best institutional models to represent the interests of future generations. It also analyzes the role of the courts regarding judicial application of intergenerational equity at the lawsuits against the states for insufficient action in environmental matters. Thus, the dissertation is organized in three chapters. Initially, in the first chapter, the development of the environmental right-duty is analyzed, since its appearance in the international scene to its consolidation at the most modern juridical constitutional systems, thereby confirming its role as a human fundamental right. Furthermore, seeks to demonstrate the intergenerational aspect inherent to environmental law, which essentially includes taking care of environmental issues affecting present and future generations. Finally, the study discusses about the principle of sustainability and its relationship with the responsibility for the future, and about the theory of intergeneration equity, regarding intergenerational and planetary rights and obligations, highlighting at the end the challenge of representing future generations, with a view toward an effective juridical protection of the environmental in an intergenerational perspective. In Chapter 2, the goal is to understand properly the concept and the juridical condition of future generations toward an application in the scope of this dissertation. After that, the representation of the future generations is specifically analyzed; this issue is related to democracy, since future generations are not present in the current decision-making process about the environment, a situation that favors current interests over against futures generations’ interests. Finally, the study seeks to identify and analyze the models of Commissioners or Ombudsmen and Guardians or Trustees established in some states for the representation of future generations; at the end, a classification of those institutions (as for the criteria of designation, initiative, powers and kind of representative) is proposed. The study also, urges for the adoption of monitoring procedures concerning the performance carried out by such representatives. Chapter 3 consists of an analysis of the judicial enforcement of intergenerational equity in the international and national courts. Concerning the international context, the role of the International Court of Justice (ICJ) is highlighted in that this is the main judicial body of the United Nations (UN). In the context of the national judiciaries, the growing judicialization movement dealing with environmental matters against the states for insufficient action in the environmental matters is highlighted, reinforcing at the end the role of young and minor plaintiffs in the promotion and protection of the environment in an intergenerational framework.A pesquisa apresenta a relação intrínseca entre o direito do ambiente e as gerações futuras, e tem por finalidade compreender de que forma é possível promover a representação atual dos interesses imputáveis às gerações futuras no âmbito dos procedimentos decisórios de relevância ambiental. Para esse fim, pretende determinar adequadamente a noção de gerações futuras, visando identificar modelos institucionais para a melhor representação dos interesses vindouros. Além disso, analisa o papel dos tribunais no tocante à aplicação judicial da equidade intergeracional no âmbito das ações em desfavor dos Estados por atuação insuficiente nas questões ambientais. Para tanto, a dissertação está organizada em três capítulos. No Capítulo 1, analisa-se a evolução do direito-dever ambiental, desde o seu surgimento no cenário internacional até à sua consagração nos mais modernos regimes jurídicos constitucionais, confirmando, deste modo, o seu caráter de direito humano e fundamental. Além disso, procurou-se demonstrar o aspecto intergeracional inerente ao direito do ambiente, o qual, na sua essência, se ocupa dos problemas ambientais que afetam as gerações presentes e futuras. Por fim, discorre-se sobre o princípio da sustentabilidade e da sua relação com a responsabilidade pelo futuro; e acerca da teoria da equidade intergeracional, relativamente aos direitos e obrigações intergeracionais ou planetários, destacando, no final, o desafio relacionado com a representatividade das gerações futuras e a necessidade de o superar, com vista à proteção jurídica do ambiente numa perspectiva intergeracional. No Capítulo 2, busca-se primeiramente, compreender de forma adequada o conceito e a condição jurídica das futuras gerações que foram considerados proveitosos para uma aplicação no âmbito desta dissertação. Depois, analisa-se especificamente a problemática da representação das gerações futuras, a qual se revelou um problema democrático, uma vez que as futuras gerações não se fazem presentes na tomada de decisões atuais sobre o ambiente, o que favorece os interesses atuais em detrimento dos vindouros. Por fim, buscou-se identificar e analisar os modelos de Comissários ou Provedores e Tutores ou Curadores instituídos em determinados Estados para a representação das gerações futuras, propondo, no final, uma classificação dessas instituições (quanto aos critérios da designação, da iniciativa, dos poderes e do tipo de representante); além disso, procurou-se demonstrar a necessidade de se adotarem procedimentos de monitorização para acompanhar o desempenho de tais representantes. Por último, no Capítulo 3, analisa-se a aplicação judicial da equidade intergeracional nos tribunais a nível internacional e nacional. No contexto internacional, destacou-se o papel desempenhado pela Corte Internacional de Justiça (CIJ), que é o principal órgão judicial no âmbito da Organização das Nações Unidas (ONU). No contexto dos judiciários nacionais, destacou-se o crescente movimento de judicialização das questões ambientais instauradas contra os Estados por suposta atuação insuficiente em matéria ambiental; enfatizando, no final, o papel dos jovens e menores demandantes para a promoção e proteção do ambiente numa dimensão intergeracional
