PRINCIPLES AND POLICIES AS A FUNDAMENT TO THE ‹‹EMANCIPATION›› OF THE JUDICIAL POWER: BETWEEN COHERENCE AND SUBVERSION OF DOWRKIN’S THEORY OF LAW

In one hand, strongly influenced by common law traditions, the contents of the United States Constitution focuses on a positivistic approach to federalism and the relations among national, state, and local governments (since the United States independency), as opposed to focusing its language on fundamental rights (at a constitutional level), which left no choice for the United States Supreme Court but to rule on matters that appeared to exceed their competence. Academics and critics regarded such rulings as a form of judicial activism, due to their being antagonistic to the classical doctrine and self-restraint principles. Nonetheless, the Constitution of the Federal Republic of Brazil of 1988, regarded as analytical and rooted in civil law customs, implemented in its language several legal guaranties, which eventfully resulted in rendering an inefficient execution of public policies. Consequently, the Brazilian judicial branch, especially the Supreme Federal Court, when incited, and in ruling according to its competencies, which have been bestowed by the Carta Magna, shall provide a legal remedy to an issue arisen in the political sphere. In this context, Dworkin presents us its vast and scrupulous theory, which reveals that as a set of political morality, the law shall manifest through the arguments of principle, and if projected into judicial scope, through certain arguments of policy. The law, understood as a construct of civilization, shall be seen as an “end to a means,” not the other way around, for its implementation seeking extrajudicial objectives is to be impeded and rejected, pursuant to Doworkin’s proposal, as well as the concept of discretion and having free creation of law in difficult and tragic cases—like it is seen in the jurisprudential doctrine. An unsuccessful interpretation of Dowrkin’s theory and a rebuttable conception of judicial activism (as in a poorly translated foreign transcript), could mistakenly associate an objective proposal to an antonymous meaning. Thus, by imposing a methodology grounded in a critic-reflexive posture and in the bibliographic review of authors who have striven to try and find clarification on the issues herein brough to light, we seek to redevelop the concept of judicial review in the Brazilian context, keeping it apart from the law as integrity, and retaining it in the conducts of functional materialists.Diferentes tradições histórico-culturais proporcionam diferentes contextos para a concepção, criação e aplicação do Direito. Por um lado, fortemente influenciada pela tradição da Commom Law, a Constituição Norte-Americana preocupou-se mais com a positivação das regras de regência dos Estados após sua Independência e menos com os direitos e garantias fundamentais (a nível constitucional), forçando os juízes de sua Supreme Court a tomarem decisões que pareciam exceder suas competências. Tais decisões passaram a ser consideradas ativistas pelos críticos e pela academia, entendidas por muitos como uma postura antagônica à doutrina originalista e ao sef-restraint. Por outro, a Constituição da República Federativa do Brasil de 1988, tida como analítica e enraizada na tradição da Civil Law, trouxe em seu texto inúmeras garantias que por vezes, as políticas públicas se mostraram insuficientes para sua execução e efetivação. Assim, o Poder Judiciário Brasileiro, principalmente o Supremo Tribunal Federal, quando provocado, nos moldes das competências que lhe foram atribuídas pela Carta Maga, deverá oferecer uma resposta jurídica à um problema originariamente político. Nesta senda, Dworkin nos presenteia com sua vasta e minuciosa Teoria, nos revelando que como um ramo da moralidade política, o Direito deverá se manifestar através dos arguments of principle e, se projetados em uma dimensão jurídica, de certos arguments of policy. O Direito tido como um projeto de realização civilizacional, deverá ser visto como fim e não como meio, razão pela qual, sua instrumentalização para o alcance de objetivos extrajurídicos é algo a ser combatido e rejeitado na proposta de Dworkin, bem como, a ideia de discricionariedade e criação livre do Direito nos casos tidos como difíceis e trágicos – assim como ocorre na proposta Jurisprudencialista. Uma má interpretação de sua Teoria e uma concepção controversa de ativismo judicial (como um texto mal traduzido em língua estrangeira) poderá unir erroneamente uma proposta objetiva a um conceito antinômico. Assim, por meio de uma metodologia pautada em uma postura crítico-reflexiva e na revisão bibliográfica de autores que tem se debruçado na tentativa de clarificação dos problemas postos em causa, buscamos reformular o conceito de ativismo judicial no contexto brasileiro, o afastando do Direito Como Integridade e o inserindo nas condutas dos funcionalistas materiais
