La métropole : un nouveau territoire du droit au logement au Brésil

The approval of the 2015 Brazilian Federal Law N. 13.089, named Metropolis Statute, established the guidelines of a new legal regimen applicable to Brazilian metropolitan regions. This statute was based on the cooperation and development of an inter-federal management intended to plan, direct, and execute the "public policies of common interest". Considering the central role of housing in the production of metropolitan space, and the specificities of this problem that impacts large urban agglomerations, it is crucial to associate the housing policy to the common interest. This has innumerable legal consequences such as the modification of competences of federal entities, the need to integrate local urban policies with the housing policy, the creation of an integrated urban plan for the metropolitan territory, the creation of law instruments and management structures capable of assuring the implementation of the right to housing in the metropolis as well as the prevision of a stable and independent financing regimen. If, on one side, the metropolis seems to be the territorial level responsible for assuring this right on the spaces subjected to the phenomenon of the metropolization, on the other side, the implementation of a metropolitan housing policy should still face several challenges that will occur mostly from the fragility - still present - of the metropolitan regimen along with the power of the local administration since the Federal Constitution of 1988, that supports the local resistance to the strengthening of an inter-federal administration.L’approbation de la loi fédérale nº 13.089 en 2015 au Brésil, dite Statut de la métropole, a précisé les directives du nouveau régime juridique applicable aux aires métropolitaines brésiliennes, fondé sur la coopération et le développement d’une gouvernance interfédérative pour planifier, gérer et exécuter les « politiques publiques d’intérêt commun ». Étant donné le rôle majeur du logement dans la production de l’espace métropolitain et les spécificités de ce problème qui touche les grandes agglomérations urbaines, il s’avère indispensable d’associer la politique du logement à l’intérêt commun. Cela a de nombreuses conséquences juridiques, telles que la modification des compétences des entités fédérées, la nécessité d’articuler les politiques locales urbaines à celle du logement, l’élaboration d’une planification urbaine intégrée de l’ensemble du territoire métropolitain, celle de créer des instruments juridiques et des structures administratives capables d’assurer la mise en œuvre du droit au logement dans les métropoles, ainsi que la prévision d’un régime de financement stable et autonome. Si, d’un côté, la métropole s’avère être le niveau territorial pertinent pour garantir ce droit dans les espaces soumis au phénomène de la métropolisation, de l’autre, la mise en pratique d’une politique métropolitaine du logement doit encore affronter divers défis issus notamment d’une fragilité toujours ressentie du statut métropolitain et de la puissance du municipalisme depuis la Constitution fédérale de 1988, qui soutiennent les réticences locales vis-à-vis du renforcement d’une gouvernance interfédérative
