AS POSSIBILIDADES DE UM INSTRUMENTO: O ESTUDO DE IMPACTO DE VIZINHANÇA E SUA UTILIZAÇÃO EM BELO HORIZONTE

This paper discusses the Neighborhood Impact Study (NIS), an urban management tool provided by the City Statute, which enables the evaluation of the impacts caused by the enterprises to be inserted into the urban environment, in order to point out the implementation feasibility, as well as the mitigation, compensatory and the potentiating measures. The study aimed to illustrate the mechanism of the Neighborhood Impact Study through its application in Belo Horizonte and the controversial urban licensing process for two hotels to be implanted in the Pampulha’s Special Guideline Area. The case study showed that even restrictive laws, such as those related to the Special Guideline Areas, can be modified to become more permissive and the Neighborhood Impact Study good intentions canceled before the strength of the economic interests.Este trabalho discute o Estudo de Impacto de Vizinhança (EIV), instrumento de gestão urbana previsto pelo Estatuto da Cidade, que possibilita a análise dos impactos causados por empreendimentos a serem inseridos no meio urbano, com a finalidade de apontar a viabilidade da implantação, bem como as medidas mitigadoras, compensatórias e potencializadoras. Buscou-se ilustrar o instrumento através de sua aplicação em Belo Horizonte e do controverso processo de licenciamento urbanístico de dois hotéis a serem implantados na Área de Diretrizes Especiais da Pampulha. O estudo de caso permitiu verificar que mesmo legislações com caráter restritivo, como as relativas às Áreas de Diretrizes Especiais, podem ser modificadas para se tornar mais permissivas e as boas intenções de um EIV anuladas perante a força dos interesses econômicos
