Tax evasion as a product of an anachronic tax policy

El objetivo del presente artículo, es indagar sobre la evasión fiscal como consecuencia de una Política Tributaria que se ha quedado relegado en el tiempo debido a que no ha evolucionado junto con la sociedad. Los altos niveles de evasión fiscal en nuestro son el correlato de un sistema tributario que ha sido estructurado por una política tributaria que se sustentó en la realidad económica de los años 90. Este desface (política tributaria estructurado en un sistema tributario de otra época), impacta negativamente en el desarrollo económico de nuestro país, pues lejos de buscar la ampliación la base contributiva para una mayor recaudación tributaria, incentiva el aumento de evasión fiscal causando graves perjuicios económicos al Estado peruano. La evasión fiscal o tributaria impide al Estado contar y disponer de recursos económicos restringiendo drásticamente el cumplimiento de sus obligaciones constitucionales el cual es satisfacer las necesidades de la población, a través del gasto público, para lograr el bien común. Todos los esfuerzos por combatir la evasión fiscal se centran en aspectos cuantitativos, es decir, solo buscan incrementar tasas de los impuestos para pretender recaudar más. No se considera la cualidad de los hechos económicos ni de su entorno. Esto nos motivó a realizar el presente estudio.  The objective of this article is to investigate tax evasion as a consequence of a Tax Policy that has been relegated in time because it has not evolved together with society. The high levels of tax evasion in our country are the correlate of a tax system that has been structured by a tax policy that was based on the economic reality of the 90s. This mismatch (tax policy structured in a tax system from another era), It has a negative impact on the economic development of our country, since far from seeking to expand the tax base for greater tax collection, it encourages increased tax evasion causing serious economic damage to the Peruvian State. Tax or tax evasion prevents the State from having and having economic resources drastically restricting the fulfillment of its constitutional obligations, which is to satisfy the needs of the population, through public spending, to achieve the common good. All efforts to combat tax evasion focus on quantitative aspects, that is, they only seek to increase tax rates to try to collect more. The quality of the economic events or their environment is not considered. This motivated us to carry out the present study
