Le pillage du patrimoine archéologique terrestre en France métropolitaine

The contemporary looting of the terrestrial archaeological heritage in metropolitan France has never been the subject of an exhaustive study. This dissertation, therefore, draws up an assessment, through a singular study, which is based on a mainly archaeological approach, while integrating a perspective with the law and ethnography. In particular, it provides information on the legislation and recalls the attacks on the heritage of the soil archives, essentially that linked to archaeological looting. The analysis traces the history of thefts of archaeological objects and the materiality of looting; for the latter, i.e. the means and aspects, the many forms implemented (remediation, rally-detection, magnet fishing, sales, etc.) by the treasure hunters, the dealers in soil artefacts belonging to the community of prospectors, detectorists who carry out looting and various forms of trafficking in archaeological objects. This study required, on the one hand, to define this heterogeneous French community and the metal detection market as well as the lobbies that emanate from it around the motivations, reasons, practices, etc. And, on the other hand, to study their relationship with French legislation.This work also addresses the characteristics and consequences of depredation, as well as its constant impact on the nature and study of archaeological sites. Archaeological looting highlights the deterioration of the environment and the context of the sites and the loss of certain data from the field: they are objects destroyed through lack of interest or ignorance, they are decontextualised artefacts. These objects feed the collections and the great illicit trafficking in archaeological goods in France and throughout the world.This dissertation has raised various pitfalls (around the collection of data, the elaboration of statistics, etc.). It proposes avenues of reflection and work to protect the national archaeological resource and to remedy the scourge of looting more effectively, based on an in-depth analysis of the various preventive measures (study of the various restrictive, prohibitive and conciliatory legislative systems, actions in favour of the protection of the archaeological heritage, etc.) and coercive measures (legal proceedings, judgements, etc.) that exist. This perspective thus provides the French legislator with additional tools for strengthening the protection of the archaeological heritage. It proposes the evolution or implementation of certain regulations, particularly including metal detectors, and of an adapted public policy about detectorism. Thus, if we give ourselves the means and amplify the actions proposed in this thesis paper, the public and the legal services will be more aware, informed and trained to better understand the fragility of the archaeological and historical heritage (a non-renewable resource and the memory of Humanity). We need to be better prepared to protect archaeological remains from looting and to fight against the illicit trafficking of archaeological goods, which remains the third largest trade in the world after arms and drugs.Le pillage contemporain du patrimoine archéologique terrestre en France métropolitaine n'avait jamais fait l'objet d'une étude exhaustive. Ce mémoire en dresse donc un bilan, au travers d'une étude singulière, qui s'appuie sur une approche principalement archéologique, tout en intégrant une mise en perspective avec le droit et l'ethnographie. Elle informe notamment, sur la législation et fait le rappel des atteintes portées au patrimoine des archives du sol, essentiellement celle liée au pillage archéologique. L'analyse retrace l'histoire des vols d'objets archéologiques et la matérialité du pillage ; pour cette dernière, c'est-à-dire les moyens et les aspects, les nombreuses formes mises en œuvre (dépollution, rallyes-détection, pêche à l'aimant, ventes, etc.) par les chineurs, les brocanteurs de la terre appartenant à la communauté des prospecteurs, des détectoristes qui font le pillage et les divers trafics d'objets archéologiques. Cette étude a nécessité, d'une part, de définir cette communauté française hétéroclite et le marché de la détection métallique ainsi que les lobbies qui en émanent autour des motivations, des raisons, des pratiques, etc. Et, d'autre part, d'étudier leur rapport à la législation française.Ce travail aborde également les caractéristiques et les conséquences de la déprédation, ainsi que ses incidences constantes sur la nature et l'étude des sites archéologiques. Le pillage archéologique met en exergue une détérioration de l'environnement, du contexte des sites et une perte de certaines données du terrain : ce sont des objets détruits par inintérêt ou par ignorance, ce sont des mobiliers décontextualisés. Ces derniers alimentent les collections et le grand trafic illicite des biens archéologiques en France et à travers le monde.Ce mémoire a permis de soulever différents écueils (autour de la collecte de la donnée, de l'élaboration de la statistique, etc.). Il propose des pistes de réflexion et de travail pour protéger la ressource archéologique nationale et remédier plus efficacement au fléau du pillage, en s'appuyant sur une analyse approfondie des différentes mesures préventives (étude des divers systèmes législatifs restrictifs, prohibitifs et de conciliations, d'actions en faveur de la protection du patrimoine archéologique, etc.) et coercitives (actions judiciaires, jugements, etc.) existantes. Ainsi cette mise en perspective offre au législateur français des outils supplémentaires en faveur d'un renforcement de la protection du patrimoine archéologique. Elle propose l'évolution ou la mise en œuvre de certaines réglementations, notamment à l'égard du détecteur de métaux, et d'une politique publique adaptée concernant le détectorisme. Ainsi, si l'on se donne les moyens et qu'on amplifie les actions proposées dans ce mémoire, les publics et les services judiciaires seront davantage sensibilisés, informés et formés à mieux comprendre la fragilité du patrimoine archéologique et historique (une ressource non renouvelable et mémoire de l'Humanité). Il convient d'être mieux armé pour protéger les vestiges archéologiques du pillage et lutter contre le trafic illicite des biens archéologiques, qui demeure le troisième trafic mondial après celui des armes et des produits stupéfiants
