IMPLIKASI HUKUM TERHADAP PERGESERAN TINDAK PIDANA DARI DELIK BIASA MENJADI DELIK ADUAN DALAM UNDANG-UNDANG HAK CIPTA DITINJAU DARI PERLINDUNGAN PEMEGANG HAK CIPTA

The rule of law provides protection for creators, so the Copyright Act (UUHC) is made. Intellectual Property Rights (IPR) were created to protect Copyright holders from copyright infringement, but over time the government and the DPR have revised the UUHC with one of them changing the types of ordinary offenses into complaint offenses that can weaken legal protection for creators. The purpose of this study was to find out the rationale for changing the type of ordinary offense into a complaint offense and the impact of changing the type of ordinary offense into a complaint offense using the normative juridical method. The conclusion that can be drawn from this analysis is that the performance of law enforcement in eradicating copyright complaint offenses will not be realized, because there will be no groundbreaking and effective law enforcement steps. Ordinary offenses can not only guarantee the realization of justice for copyright holders, but also justice for the general public who enjoys their creation
