PENGEDARAN PSIKOTROPIKA KEPADA TEMAN SEJAWAT DI KALANGAN USIA PRODUKTIF (Studi Kasus Putusan Perkara Nomor 321/Pid.Sus/2020/PN Yyk. di Pengadilan Negeri Yogyakarta)

This study is an attempt to find out the considerations and decisions of judges at the Yogyakarta District Court in deciding cases of illegal distribution of psychotropics and without the right to hand over psychotropics without permission from the authorities. In its decision, the Panel of Judges sentenced the Defendant to imprisonment for 7 (seven) months and a fine of Rp. 2,000,000,- (Two million rupiah), with evidence of 1 (one) black sling bag containing 5 (five) Atarax pills (Alprazolam 1 mg), 1 (one) Sanitas Pharmacy drug collection card, 1 ( one) Puri Nirmala RSK drug taking card and 1 (one) black and blue Vivo cellphone were seized for destruction. This type of research is a library research. This research was conducted using a normative juridical approach. Data collection techniques used literature study and documentation by collecting primary and secondary legal materials. Qualitative data analysis techniques. The results of the study concluded that: First, it was stated that the Defendant Dicky Chrisnia Wirawan bin Romadhon (late), was legally and convincingly proven guilty of committing the crime of "delivering psychotropic substances other than those stipulated in Article 14 paragraph (1), Article 14 paragraph (2), Article 14 paragraph (3), Article 14 paragraph (4) of the Law of the Republic of Indonesia Number 05 of 1997 concerning Psychotropics”.
