The EU and its Member States must guarantee the respect of citizens’ right of access to environmental information, public participation in decision-making and access to justice in environmental matters. Nevertheless, no framework for access to justice in the EU Member States exists. On 14 October 2020, the European Commission adopted a legislative proposal amending the Aarhus Regulation as part of the European Green Deal. The aim is to strengthen the EU’s system of access to justice in environmental matters, including the role of the Member States and national courts.
