Ochrona prawnokarna zabytków w świetle ustawodawstw wybranych państw byłego bloku komunistycznego

The article aims at shedding light on legislation in the states of the post-communist bloc in the aspect of legal and criminal protection of monuments. The article is a springboard for deliberations on the solutions for criminal law protection of monuments in post-communist states. They share similar historical experiences. Legislations of the following countries have been included in the analysis: Albania, Czech Republic, Estonia, Latvia, Slovakia, Slovenia, Ukraine, Hungary, and Russia. The overview of legal solutions opens with a discussion of respective regulations in the codes and outside the codes. It is concluded by a summary including observations concerning common elements and significant differences in the presentation of this problem in respective countries.Celem artykułu jest przybliżenie ustawodawstw państw byłego bloku komunistycznego w aspekcie prawnokarnej ochrony zabytków. Artykuł jest przyczynkiem do rozważań nad rozwiązaniami dotyczącymi ochrony karnej zabytków w państwach postkomunistycznych. Łączą je podobne doświadczenia historyczne. Analizą objęto ustawodawstwa Albanii, Czech, Estonii, Łotwy, Słowacji, Słowenii, Ukrainy, Węgier i Rosji. Przegląd rozwiązań prawnych ułożono w ten sposób, że najpierw omówione zostały poszczególne regulacje kodeksowe i pozakodeksowe, a następnie zamieszczono podsumowanie, w którym znajdują się wskazania dotyczące elementów wspólnych oraz istotnych różnic odnośnie do tej problematyki w poszczególnych krajach
