پیشگیری از فساد مالی در مناقصه‌ها و مزایده‌ها با تأکید بر اخلاق و حکومت قانون

Background and Aim: The process of government transactions is always accompanied by the possibility of doing illegal acts due to the possibility of obtaining benefits. The development of government transaction regulations by the government, as well as the approval of the law on tenders by the legislator, are efforts to reduce the incidence of such illegal acts, However, government transactions have not been protected from corruption, and we are witnessing the growth of financial corruption in the process of holding government tenders and auctions. This study aims to investigate prevention in this area with emphasis on ethical and legal principles. Materials and Methods: This research is theoretical; the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In all steps of this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: Numerous negative consequences of corruption, especially from the perspective of degrading social ethics, have led the three powers of government, especially the executive branch, to adopt amendments to laws and regulations, eliminate the shortcomings of the administrative and executive structure in the process of conducting government transactions and mobilize regulatory bodies to try to prevent corruption in this area. Conclusion: Reforming the economic structure through privatization as well as expanding the environment of competition and transparency, raising the scientific level and awareness of government employees and individuals in society, along with strengthening mass media in order to provide accurate and transparent information about laws and regulations of conducting government transactions and familiarity with the financial corruption that can be committed in the process of providing government goods and services and deepening moral propositions will be among the effective tools to prevent corruption.   Cite this article as: Talenasab V, Sadeghnejad Naeeni M, Mehdi Mansouri SM. Majale "Akhlāq-i zīstī" (i.e., Bioethics Journal). 2021; 11(36): e21.زمینه و هدف: فرآیند معاملات دولتی به دلیل امکان به دست‌آوردن منفعت مادی همواره با احتمال ارتکاب اعمال غیر قانونی همراه است. تدوین آیین‌نامه‌های معاملات دولتی از سوی دولت و همچنین تصویب قانون برگزاری مناقصات از سوی قانونگذار تلاشی است که در راستای کاهش بروز این‌گونه اعمال غیر قانونی صورت پذیرفته است، اما با وجود این معاملات دولتی مصون از تعرض نگردیده است و شاهد رشد مفاسد مالی در روند برگزاری مناقصه‌ها و مزایده‌های دولتی می‌باشیم. این مطالعه با هدف بررسی رویکردهای پیشگیرانه در این حیطه با تأکید بر مبانی اخلاقی و قانونی انجام یافته است. مواد و روش‌ها: این تحقیق از نوع نظری است؛ ‌روش تحقیق به صورت توصیفی ـ تحلیلی می‌باشد و روش جمع‏آوری اطلاعات به شیوه کتابخانه ‏ای و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمامی مراحل انجام پژوهش، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافته‌ها: پیامدهای منفی فراوان فسادهای مالی به ویژه از منظر تضعیف اخلاق اجتماعی، مجموعه قوای سه‌گانه و علی‌الخصوص دولت را بر آن داشته است تا با اتخاذ اصلاحات در قوانین و مقررات، رفع نواقص ساختار اداری و اجرایی در روند برگزاری معاملات دولتی و بسیج ارگان‌های نظارتی تلاش نمایند تا از معضل فساد در این حوزه پیشگیری کنند. نتیجه‌گیری: اصلاح ساختار اقتصادی از طریق خصوصی‌سازی و نیز گسترش فضای رقابت و شفاف‌سازی، ارتقای سطح علمی و آگاهی کارکنان دولت و افراد جامعه در کنار تقویت و تجهیز رسانه‌های گروهی به منظور امکان اطلاع‌رسانی دقیق و شفاف قوانین و مقررات فرآیند برگزاری معاملات دولتی و آشنایی با مفاسد مالی قابل ارتکاب در روند تأمین کالاها و خدمات دولتی و تعمیق گزاره ­های اخلاقی، از جمله ابزارهای مؤثر برای پیشگیری از فساد مالی خواهد بود
