[The Application of Maqasid al-Shari’ah in The Method of Istinbat Sayidatina ‘Aishah Abu Bakar R.A.] Aplikasi Maqasid al-Shari’ah dalam Metode Istinbat Hukum Sayidatina ‘Aishah Abu Bakar R.A.

Maqāṣid al-sharī’ah is an important element that needs to be properly examined by the mujtahids in the process of determining and implementing the law. This is because maqāṣid al-sharī’ah are the objectives that have been set by the Islamic law to be achieved in realizing the welfare of human beings in this world and the hereafter. To achieve that goal, maqāṣid al-sharī'ah can be applied by mujtahids in several aspects such as inshā'ī which is the determination of law for newfangled problems, the aspect of tarjīḥī which is the selection of the strongest view, the aspect of taṭbīqī which is the reconstruction of law based on current reality and the aspect of tafsīri which is the understanding on the contextual meaning of Islamic sources. Sayidatina ‘Āishah Abū Bakar r.a is famous as one of the seven companions of the Prophet s.a.w who were most actively involved in ijtihad and fatwa. However, it can be observed that the aspect of law determination based on maqāṣid al-sharī’ah in ijtihad and fatwa of Sayidatina ‘Āishah is less highlighted by researchers. Thus, this paper aims to take a closer look at the influence and application of maqāṣid al-sharī’ah in the method of istinbāṭ by Sayidatina ‘Āishah Abū Bakar r.a in some selected fiqh issues. This qualitative approach-based study uses content analysis that involves the document analysis method. The secondary data highlighted and analyzed in this study were obtained through traditional and contemporary scholarly books, journal articles, and theses. The study found that Sayidatina ‘Āishah Abū Bakar r.a applied the principles of maqāṣid al-sharī’ah in the determination of law for the issues raised. She rejected, criticized, and re-evaluated the views of law which she perceived as contradictory to the maqāṣid al-sharī’ah and the universal principles of Islamic jurisprudence (kulliyyāt tashrī’iyyah). Maqāṣid al-sharī’ah merupakan elemen penting yang perlu diambil kira oleh para mujtahid dalam proses penetapan dan pelaksanaan sesuatu hukum. Hal ini demikian kerana maqāṣid al-sharī’ah adalah matlamat-matlamat yang telah ditetapkan oleh syarak untuk dicapai bagi merealisasikan kemaslahatan dan menolak kemudaratan di dunia dan akhirat. Bagi mencapai tujuan tersebut, maqāṣid al-sharī’ah boleh diaplikasikan oleh para mujtahid dalam beberapa aspek seperti inshā’ī iaitu penetapan hukum bagi permasalahan baharu, aspek tarjīḥī iaitu pemilihan pandangan yang terkuat, aspek taṭbīqī iaitu pembinaan semula hukum berdasarkan realiti semasa dan aspek tafsīri iaitu pemahaman makna nas syarak secara kontekstual. Sayidatina ‘Āishah binti Abū Bakar r.a terkenal sebagai antara tujuh orang sahabat Nabi s.a.w yang paling aktif terlibat dalam ijtihad dan fatwa. Walau bagaimanapun, pemerhatian mendapati bahawa aspek penetapan hukum berasaskan maqāṣid al-sharī’ah dalam ijtihad dan fatwa Sayidatina ‘Āishah kurang ditonjolkan oleh para penyelidik. Justeru, penulisan ini bertujuan untuk melihat secara dekat pengaruh dan aplikasi maqāṣid al-sharī’ah dalam metode istinbāṭ hukum oleh Sayidatina ‘Āishah binti Abū Bakar r.a dalam beberapa isu fiqah terpilih. Kajian berasaskan pendekatan kualitatif ini berbentuk analisis kandungan yang melibatkan protokol analisis dokumen. Data-data sekunder yang disoroti dan dianalisis dalam kajian ini diperoleh melalui kitab-kitab sarjana silam dan kontemporari, artikel jurnal dan tesis. Kajian mendapati bahawa Sayidatina ‘Āishah binti Abū Bakar r.a mengaplikasikan prinsip-prinsip maqāṣid al-sharī’ah dalam pengeluaran hukum bagi isu-isu yang dibangkitkan. Beliau menolak, mengkritik dan membuat penilaian kembali terhadap pandangan-pandangan hukum yang dilihatnya sebagai bercanggah dengan maqāṣid al-sharī’ah dan prinsip-prinsip universal perundangan Islam (kulliyyāt tashrī’iyyah)
