PERLINDUNGAN HUKUM KONSUMEN DARI PRODUK PANGAN KADALUARSA DITINJAU DARI UNDANG-UNDANG NOMOR 8 TAHUN 1999 TENTANG PERLINDUNGAN KONSUMEN

 Food is the most important basic human need and its fulfillment is part of the human rights of every Indonesian people. Food must always be available in sufficient, safe, quality, nutritious, and varied manner at a price that is affordable by the people's purchasing power, and does not conflict with the religion, belief, and culture of the community. Expiration is a condition where a product is said to be unfit because it has passed the time specified is feasible on the packaging. The circulation of food made from expired ingredients cannot be separated from the responsibility of the government as the party authorized to make regulations. In this case, Law Number 8 of 1999 concerning Consumer Protection has regulated this matter. This study aims to determine the form of consumer legal protection from expired food products in terms of Law Number 8 of 1999. This type of research is library research. The results of this study conclude that legal protection consists of preventive protection and repressive protection. The form of consumer protection from expired food products in terms of law number 8 of 1999 is contained in article 7 points f and g jo article 19 paragraphs 1 and 2 where business actors are responsible provide compensation for damage, pollution, and or loss of consumers due to consumption of goods and/or services produced or traded, compensation in the form of refunds or replacement of goods and/or services of similar or equivalent value, or health care and/or compensation provided in accordance with applicable laws and regulations
