Dos modelos del orden constitucional: las garantías del orden y las medidas de coerción gubernamental en la Ley de Bonn

In the present article we will make an analysis about the situation of the Federal Republic of Germany in her first´s years after de Second great war. On one hand we will focus on the government politics and the notion of Ordnung: the juridical debate on the constitutional order was posed in terms of fundamental rigths. The problem there was the formal and limitative character of the subjective guaranties, and the material contain of the social and administrative laws. Ernst Forsthoff has made a critic on the notion of social Rule of law on the basis of a duality between legality and administration. But in front of this constitutional conception the economic Counsel of the federal Republic works on the notion of order in terms of regulation and government.En el presente artículo vamos realizar un análisis de la noción de orden normativo en la República Federal Alemana en sus primeras dos décadas. Por un lado encontramos un debate jurídico en torno al orden normativo constitucional en términos de derecho fundamentales: el problema va a estar en el modo en que los derechos subjetivos de carácter limitante vienen a extender sus garantías a derechos sociales de carácter programático, tal como lo formuló Ernst Forsthoff, con respecto a la Ley de Bonn distinguiendo la legalidad y la administración. En segundo lugar vamos a ver como se forma una noción de orden regulativo en términos de las reformas del Consejo económico que operan en términos estrictamente gubernamentales
