PRAKTIK DOWNLOAD FILM MELALUI APLIKASI TELEGRAM DALAM PERSPEKTIF SOSIOLOGI HUKUM DAN MAQĀṢID AS-SYARĪ’AH (Studi Terhadap Mahasiswa Yogyakarta Universitas SK Pada Tahun 2021)

There are several habits carried out by the community during the Covid-19 pandemic, especially in early 2021 until May 2021, many people use the telegram application to download films available on the Telegram channel, this is also done by SK University students. Recently, searching for movies via the Telegram application has become increasingly common. It is written in Law Number 28 of 2014 that one of the things that is protected is cinematographic works. The film has copyright which protects all rights attached to the work. The practice of downloading movies through non-official sites without a viewing permit from related parties is increasingly prevalent. Therefore, this study will discuss why Yogyakarta students practice downloading films through the Telegram application and how this practice is viewed from the perspective of sociology of law and Maqāṣid as-Syarī'ah. With this type of empirical legal research or also called field research (field research). The theory that will become the analytical knife of this research is legal protection, Maqāṣid as-Syarī'ah, the legal system, and copyright. The results of this study can be concluded that from a review of the sociology of law this practice is motivated by several factors, both internal and external factors originating from the student. Social factors also affect the practice of downloading films through the Telegram application by Yogyakarta SK University students in 2021. The limited circumstances of the community can be the reason for the community's need to take advantage of the films that circulate easily on the Telegram group channel as an effort to carry out their lives. However, there are limitations, where it is permissible to carry out this practice just to relieve boredom and become entertainment for people's lives and not to exceed the limit. With the content in Maqāṣid as-Syarī'ah is benefit, what should happen is that a film work produces benefits for film lovers as well as for film creators or film copyright holders
