IMPLEMENTASI PERATURAN MAHKAMAH AGUNG NOMOR 4 TAHUN 2020 TENTANG ADMINISTRASI DAN PERSIDANGAN PERKARA PIDANA DI PENGADILAN SECARA ELEKTRONIK (Studi di Pengadilan Negeri Sleman Kelas 1A)

The presence of the Covid-19 virus in Indonesia has caused problems that the physical criminal trial process in the courtroom cannot be fully carried out. In response to this, the Supreme Court has issued Supreme Court Regulation Number 4 of 2020 concerning the Administration and Trial of Criminal Cases in Courts Electronically, which was previously carried out in the courtroom due to the Covid-19 pandemic so that the trial was conducted electronically. The large number of confirmed positive Covid-19 in Sleman Regency affects the implementation of the trial in the Sleman District Court courtroom. In addition, there are many cases that enter every year, so this is a delay or accumulation of cases (over crowding) at the Sleman District Court due to the Covid-19 pandemic. The Sleman District Court is required to implement an electronic trial, therefore, this study wants to see whether the practice of Electronic court trial in the Sleman District Court is in accordance with the provisions criminal procedure code. This type of research is field research to see how the trial at the Sleman District Court is a descriptive analysis using an empirical juridical approach which is strengthened by a qualitative deductive analysis. The results of research on the Administration and Process of Criminal Cases in the Court Electronically concluded several things: First, the Sleman District Court in implementing the trial electronically was in accordance with the provisions of PERMA Number 4 of 2020 and was in accordance with the provisions of the Criminal Procedure Code, namely the principle of an open trial. for the public, the principle of fast, simple, and low cost, the principle of the presence of the defendant in court, the principle of direct and oral examination of the judge. Third, in terms of electronic criminal case administration at the Sleman District Court, it has not been implemented as regulated in PERMA
