PERLINDUNGAN KORBAN KEKERASAN SEKSUAL DALAM RUMAH TANGGA MENURUT RANCANGAN UNDANG-UNDANG PENGHAPUSAN KEKERASAN SEKSUAL

There are three laws rules domestic sexual violence. First, the Criminal Code (KUHP) which regulates forms of sexual violence, rape and sexual abuse. Second, Law no. 23 of 2004 concerning the Elimination of Domestic Violence which regulates the prohibition of domestic violence. And third, Law no. 35 of 2014 concerning amendments to Law no. 23 of 2002 concerning child protection which regulates forms of economic violence and sexual violence against children. Even though there have been regulations related to sexual violence, the fact is there are still many victims of sexual violence cases who have not fully protected and fulfilled their rights and even more victims. This is in accordance with the data released by Komnas Perempuan showing that there were 431,471 total cases of violence against women that occurred throughout 2019. In the same year, Mitra Pengada Layanan also stated that 11,105 cases of violence against women in the private / family sphere occurred, where sexual violence is a form of violence that dominates, amounting to 2,807 (25%) of the total cases. This is a library research type which uses manuscripts, books, texts and relevant papers as the main source. This research is using a descriptive-analytical study that describes a problem which is then analyzed using a qualitative normative approach with various literature sources related to the regulations of domestic violence and sexual violence. The results of this study indicate that domestic sexual violence according to the draft law on the elimination of sexual violence (RUU PKS) is sexual violence in the form of sexual harassment, sexual exploitation, forced contraception, forced abortion, rape, forced marriage, forced prostitution, sexual slavery and sexual torture. Furthermore, victims of sexual violence in household receive preventive and repressive legal protection. The preventive protection is about form of the right to protection and prevention of sexual violence, and repressive protection is formed by imposition of main and additional crimes against the perpetrator
