SIKAP PENERBIT TERHADAP PEMBAJAKAN BUKU DI YOGYAKARTA (Studi Kasus Mizan Bentang Pustaka, Basa-basi, Pojok Cerpen)

Books are objects that are attached to the Intellectual Property which is owned by each creator based on the law called Copyright. Intellectual Property Rights are rights relating to property that arise because of human intellectual abilities. These abilities can be in the fields of technology, science, art, and literature. In general, Intellectual Property Rights consist of two things, namely industrial property rights and copyrights, books are included in copyrights. Several publishers in Yogyakarta have registered their ownership with the Directorate General of Intellectual Property according to procedures, so that publishers have the right to legal protection in cases of book piracy in Yogyakarta. Related to legal protection against book piracy, it is included in Article 40 of Law No. 28 of 2014 concerning Copyright. Although there are many counterfeits of books published by Mizan Bentang Pustaka, Basa-Basi, and Pojok Cerpen that have Copyright, publishers do not make demands at the Police, but what is the problem here is that if the publishers do not sue the Police then the book pirates the more massive and has become a tradition in Indonesia, the creators or writers of books will indirectly lose their enthusiasm for creating works. Therefore, this study aims to find out several things that cause publishers not to file charges at the Police and to find out how much legal confidence the publishers have in law enforcement officials in Yogyakarta. The research method that I use is a type of research (Field Research), namely conducting direct research to the publishers of Mizan Bentang Pustaka, Basa-Basi, and Pojok Cerpen. This research is categorized as a descriptive-analysis research using a sociological-empirical approach. Sociology is to study the applicable legal provisions and what is happening in reality in society. While empirical is a research based on data obtained directly from the publisher Mizan Bentang Pustaka, Basa-Basi, and Pojok Cerpen which is done through observation and interviews. The results of this study resulted in the conclusion that in practice publishers do not file charges against copyright infringers for book piracy cases based on several reasons, namely: the publishers' distrust of the law enforcement system in Yogyakarta, the presence of law enforcement officers who protect book pirates in order to make it smooth. illegal efforts, lack of awareness from the public that the importance of appreciating an intellectual property that has been created, lack of public obedience to the importance of buying books from official publishing houses, there is no clear sanction regarding people buying pirated books
