La interpretación prejudicial 242-IP-2015 del Tribunal Andino. Sobre la legitimidad activa de las autoridades administrativas para solicitar interpretación prejudicial y la aplicación de los requisitos de registrabilidad a las marcas táctiles o de textura

On August 24, 2015, the Andean Court of Justice issued the Preliminary Ruling 242-IP-2015, on the tactile mark consisting in the surface of the whisky bottle Old Parr. This Preliminary Ruling is the first one rendered by an international court about tactile marks. The purpose of this paper is to explain the application of the main registration requirements to new types of marks, in the light of the criteria explained in the aforementioned Preliminary Ruling. It also aims to analyze the previous jurisprudential development, concerning the active legitimacy of the Administrative Authorities of the Member Countries to optionally request Preliminary Rulings. That is the first question –or subject– addressed in the above-mentioned Preliminary Ruling since the interpretation was requested by an Administrative Authority of Colombia.El 24 de agosto de 2015, el Tribunal de Justicia de la Comunidad Andina emitió la interpretación prejudicial recaída en el Proceso 242-IP-2015(2), sobre la marca táctil o de textura consistente en la superficie de la botella de whisky Old Parr, la cual constituye el primer pronunciamiento de un tribunal o corte internacional referido a una marca táctil o de textura. El presente estudio analiza la aplicación de los principales requisitos de registrabilidad a este nuevo tipo de marca, a la luz de los alcances expresados en el citado pronunciamiento; así como el desarrollo jurisprudencial previo, relativo a la legitimidad activa de las autoridades administrativas para solicitar interpretaciones prejudiciales facultativas, primer tema o cuestión prejudicial desarrollada en la precitada interpretación prejudicial, en virtud de haber sido solicitada por la Dirección de Signos Distintivos de la Superintendencia de Industria y Comercio de la República de Colombia
