Reviravolta Linguístico-Pragmática e Esboços de uma Nova Hermenêutica Jurídica

This article aims to demonstrate need to reestruturate de legal hermeneutics, adjusting it to the current language paradigm. Thus, through literature review, it discusses about the paradigms of knowledge: starts from the search for essences, in paradigm of being, passing through so-called " subjugated subject" in the philosophy of consciousness, reaching the paradigm of inter-subjectivity, which aligns theory and practice and reformulates the function of language - it ceases to be purely designating element to pass the condition of possibility of knowledge. It discusses the influences of the latter paradigm for the "how" of hermeneutics, aiming to demonstrate the adoption of this new paradigm requires the reformulation of key concepts of traditional hermeneutics, including distinguishing between text and norm and how to face the phenomenon pre-understanding. Exploring these concepts, analyzes, at the end, what is the law: "What the judges say" or "what the law says." It concludes claiming law is not "what the judges say" neither "what the law says", but a third way that recognizes the need for interpretation and, the same time, compliance with the legal limits and respect for tradition.O presente artigo visa a demonstrar a necessidade de reestruturação da hermenêutica jurídica, adequando-a ao paradigma ora vigente, o da linguagem. Deste modo, por intermédio de uma revisão bibliográfica, discorre-se sobre os paradigmas do conhecimento: parte desde a busca pelas essências, no paradigma do ser, passando pelo denominado sujeito assujeitador, na filosofia da consciência, chegando ao paradigma da intersubjetividade, que alinha teoria e prática e reformula a função da linguagem - que deixa de ser elemento meramente designativo para passar a condição de possibilidade do próprio conhecimento. Discute-se as influências deste último paradigma para o como da hermenêutica, almejando demonstrar que a adoção desse novo paradigma exige a reformulação de conceitos-chave da hermenêutica tradicional, tais como distinção entre texto e norma e o modo como se encara o fenômeno da pré-compreensão. Explorando esses conceitos, estuda-se, ao fim, o que é o direito: o que os juízes dizem ou o que a lei diz. Arremata-se no sentido de que nem tanto o que os juízes dizem nem tanto o que a lei diz, mas uma terceira via que reconhece a necessária interpretação e, ao mesmo tempo, observância dos limites da legalidade e respeito à tradição
