APLICAÇÃO CONTEMPORÂNEA DA TEORIA DA CONSTITUCIONALIZAÇÃO SIMBÓLICA À CONSTITUIÇÃO DE 1988

The difficulty of implementation of the 1988 Constitution is a worrying issue, especially when taking into account the sharp inequality faced by Brazilian society. In Brazil there is a narrow and exclusionary realization of constitutional provisions. In an attempt to get a new look at the old problem, this paper aims to analyze the feasibility of the theory of symbolic constitutionalization, formulated by Marcelo Neves, to explain the current moment experienced by the Brazilian society. From a rereading of the systems theory of Luhmann, Marcelo Neves proposes a new model, adapted to the specificities of peripheral countries, in which Brazil stands out as clear example. In the scholar mentioned vision, countries belonging to the peripheral modernity there is a permanent and structural blockage of achieving the legal-constitutional programs for injunction other systemic code, hence why inclusive constitutions opposed to an exclusive reality. As a result of this situation, it would not be possible to sustain the existence of the autonomy of the legal system, hence why Neves will be complete the right one allopoietic system, marked by interference from other systems, especially politics. One indication of this situation would be checked by analysis of three fundamental constitutional principles: the constitutional legal regulation of the electoral procedure, the separation of powers and respect for fundamental rights and guarantees. In the present study aimed to weave an overview of the current stage of development of these constitutional pillars, to the end check the adequacy of the theory of symbolic constitutionalization to explain the contemporary Brazilian society.A dificuldade de concretização da Constituição de 1988 é um tema inquietante, principalmente quando se leva em consideração a acentuada desigualdade enfrentada pela sociedade brasileira. No Brasil há uma concretização restrita e excludente dos dispositivos constitucionais. Na tentativa de buscar um novo olhar sobre o antigo problema, o presente trabalho se propõe a analisar a viabilidade da teoria da constitucionalização simbólica, formulada por Marcelo Neves, para explicar o momento atual vivido pela sociedade brasileira. A partir de uma releitura da teoria sistêmica de Luhmann, Marcelo Neves propõe um novo modelo, adaptado às especificidades de países periféricos, no qual o Brasil desponta como exemplo claro. Na visão do mencionado estudioso, em países pertencentes à modernidade periférica há um bloqueio permanente e estrutural da concretização dos programas jurídico-constitucionais pela injunção de outros códigos sistêmicos, daí porque textos constitucionais includentes contrapõem-se a uma realidade excludente. Como decorrência dessa situação, não seria possível sustentar a existência da autonomia do sistema jurídico, daí porque Neves vai concluir ser o Direito um sistema alopoiético, marcado pela sobreposição de outros sistemas, em especial da política. Um indício dessa situação seria verificado através da análise de três princípios constitucionais basilares: a regulação jurídica constitucional do procedimento eleitoral, a separação dos poderes e o respeito aos direitos e garantias fundamentais. Assim, no presente trabalho procura-se tecer uma visão geral sobre o atual estágio de desenvolvimento destes pilares constitucionais, para ao final verificar a adequação da teoria da constitucionalização simbólica para explicar a sociedade brasileira contemporânea
