Ação Judicial do Imigrante Haitiano: Aspectos do Depoimento e da Tradução na Justiça do Trabalho

The shown work investigates the difficulties of haitian immigrant workers communication, when searches to repair damages in his rights under the labor courts in Brazil. It explains the duty of the Judiciary in the demands of foreigners, specifying the actions before the labor courts, and the need for interpreters, before the difficulties of communication. Talks, too, about the labor claims of Haitians, linking cases occurring before the Regional Labor Court of the 9th Region (Paraná) in the first degree of jurisdiction. As a theoretical reference, the study is guided by the theory of fundamental rights and guarantees, especially the aspect of access to justice. As for methodology, we use the deductive method in the approach and process you the descriptive method with technical literature. Translates the relevant current research theme to Brazil in order to raise the question of how it should be guaranteed to the immigrant access to justice, by understanding his speech.O trabalho que se põe a público investiga as dificuldades na comunicação do trabalhador imigrante haitiano quando busca reparar lesão a seus direitos perante a Justiça do Trabalho no Brasil. Explicita o papel do Poder Judiciário nas demandas dos estrangeiros, especificando as ações perante a Justiça do Trabalho, bem como a necessidade de intérpretes, ante as dificuldades de comunicação. Discorre, também, sobre as demandas judiciais trabalhistas dos haitianos, relacionando casos ocorridos perante o Tribunal Regional do Trabalho da 9ª Região (Paraná), no primeiro grau de jurisdição. Como referencial teórico, o estudo se orienta pela teoria dos direitos e garantias fundamentais, especialmente pelo aspecto do acesso à Justiça. Quanto à metodologia, utiliza-se o método dedutivo na abordagem e no procedimento o método descritivo, com técnica bibliográfica. Traduz a investigação tema de relevante atualidade para o Brasil, no sentido de levantar a questão de como deve ser garantido ao imigrante o acesso à Justiça, pela compreensão de sua fala
