A POSSIBILIDADE DO POLIAMORISMO ENQUANTO DIREITO PERSONALÍSSIMO E A AUSÊNCIA DE REGULAMENTAÇÃO NO DIREITO BRASILEIRO

This article is scope to examine how the right to autonomy of the will can protect polyamorous relations. From a case , far shall be a study on how this issue is being addressed in Brazil , with its legal implications . Affective relationships are not static and predetermined exhaustively by the state. On the contrary, they suffer constant changes which the public entity must seek to know and regulate reality , without however forgetting the basic principles of society. Thus , the study aims to demonstrate possible solutions for cases of polyamory arising in the country, differentiating them from other legal situations already sedimented in the jurisprudence and doctrine.O presente artigo tem por escopo analisar a forma como o direito à autonomia da vontade pode proteger as relações poliafetivas. A partir de um caso concreto, far-se-á um estudo sobre como esse tema vem sendo tratado no Brasil, com suas implicações jurídicas. As relações afetivas não são estáticas e predeterminadas de forma taxativa pelo Estado. Antes pelo contrário, sofrem constantes transformações as quais o ente público deve procurar conhecer e regulamentar a realidade, sem, contudo, olvidar os princípios básicos da sociedade. Desta forma, o estudo visa ainda demonstrar as possíveis soluções para os casos de poliafetividade que surgem no país, diferenciando-os de outras situações jurídicas já sedimentadas na jurisprudência e na doutrina
