Constitucionalismo Garantista X Neoconstitucionalismo: Limite à Discricionariedade Judicial

The aim of this exhibition is the study of the guaranteeism and its counterpoint to the neoconstitutionalism. Therefore, the main features of guaranteeism were drawn, understood as a constitutional theory of law. Subsequently, it is important to study the neoconstitutionalism, highlighting the historical, philosophical and theoretical frameworks of this conception. Finally, it aims to trace the similarities and distinctions between warranty constitutionalism and neoconstitutionalism, here understood as a principialist constitutionalism. Presented the criticism, it proposes reflection on this theory. It will be used, therefore, the logical-deductive method, using qualitative analyzes with the resources at national bibliography and the current legislation.O objetivo da presente exposição consiste no estudo da teoria garantista e o seu contraponto com o (neo)constitucionalismo. Para tanto, foram traçadas as principais características do garantismo, compreendido como uma teoria constitucionalista do direito. Posteriormente, salutar o estudo do (neo)constitucionalismo, destacando-se seus marcos histórico, filosófico e teórico. Finalmente, objetiva-se traçar as semelhanças e distinções entre o garantismo e o (neo)constitucionalismo, aqui avaliado como um constitucionalismo principialista. Diante disso, apresentadas as críticas ao neconstitucionalismo, propõe-se uma reflexão objetiva sobre essa teoria. Empregar-se-á, para tanto, o método lógico-dedutivo, através de análises qualitativas, tendo como recursos a bibliografia nacional e a legislação vigente
