What is said and what isn't: governance between the escape from law and the search for control

Conceptual changes, suggests Quentin Skinner, are simultaneously indexes and inducers of political change. Our everyday discourse operates choices, exclusions and displacements which both testify to and promote changes in the way we apprehend and signify life. This paper argues that the recent rise in prestige of the word governance as a central concept in legal discourse, especially in International Law, cannot be fully understood without taking into account the set of value changes it manifests. The first section analyses instances of re-signification of the word governance, above all when used in Law. The second suggests that this new semantics bespeaks a movement of moving away from traditional forms of legal-political organization. The third examines the hypothesis that this moving away is an attempt to respond to the complexity globalization and technological changes have brought to international relations. The fourth offers an analysis of the impact that this new perception of governance has on the idea of regulation and the fifth concludes with a discussion on the difficulties to control the legitimacy and the quality of governance.Mudanças conceptuais, sugere Quentin Skinner, são simultaneamente índices e indutores de mudanças políticas. Nosso discurso sobre o quotidiano opera escolhas, exclusões e deslocamentos que testemunham e promovem mudanças nas formas estabelecidas de apreender e significar a realidade.2 Esse texto propõe que a ascensão recente do termo governança como conceito central para os discursos jurídicos, sobretudo no âmbito do Direito Internacional, não pode ser plenamente compreendida sem que se leve em conta o conjunto de mudanças valorativas que ela manifesta. A primeira secção analisa as vertentes de ressignificação do termo governança, sobretudo em suas aplicações no campo jurídico. A segunda sugere que a nova semântica associada ao termo é marcada por uma fuga de formas tradicionais de organização político-jurídica. A terceira examina a hipótese de essa fuga representar uma tentativa de resposta ao tipo de complexificação que a globalização e as mudanças tecnológicas trouxeram às relações internacionais. A quarta secção aporta uma análise do impacto dessa nova percepção de governança sobre a ideia de regulação e a quinta concluiu com discussão dos desafios de operar controles de legitimidade e qualidade da governança
