In March 15 of 2016, Colombia requested an advisory opinion from the Inter American Court of Human Rights over the meaning of “jurisdiction”, stated on article 1.1 of the American Convention of Human Rights. In its decision, the Court adopted a broader model of jurisdiction over the individuals, in which the extraterritorial effects are, in themselves, enough to place an individual under the jurisdiction of the State which caused the damages, concerning environmental obligations on the American system. This paper analyses the advances in this understanding, relating it to sustainable development and the internationalization of the protection of the environment.
