The broader concept of extraterritorial jurisdiction on the inter american system through OC-23/17: the advances on the internacionalization of the protection of the environment

In March 15 of 2016, Colombia requested an advisory opinion from the Inter American Court of Human Rights over the meaning of “jurisdiction”, stated on article 1.1 of the American Convention of Human Rights. In its decision, the Court adopted a broader model of jurisdiction over the individuals, in which the extraterritorial effects are, in themselves, enough to place an individual under the jurisdiction of the State which caused the damages, concerning environmental obligations on the American system. This paper analyses the advances in this understanding, relating it to sustainable development and the internationalization of the protection of the environment. In order to do so, bibliographical and documental researches will be used, with a deductive methodological procedure.Em 15 de março de 2016, a Colômbia solicitou uma opinião consultiva à Corte Interamericana de Direitos Humanos sobre o significado de “jurisdição” presente no artigo 1.1 da Convenção Americana de Direitos Humanos. Em sua decisão, a Corte adotou um modelo ampliado de jurisdição quanto à pessoa, em que os efeitos extraterritoriais são, em si, suficientes para colocar um indivíduo sob a jurisdição do Estado causador de danos, no que diz respeito às obrigações ambientais no sistema americano. O presente trabalho analisa os avanços nessa compreensão, relacionando-a com o desenvolvimento sustentável e com a crescente internacionalização da proteção do meio ambiente.
