The limits of resistence and power in the relationship between human rights and biopolitics

Revista Dialectus, Fortaleza, v. 4, n. 11, p. 88-99, ago./dez. 2017.This research work aims at reflecting about Human Rights in terms of the notion of Biopolitics, taking into account theoretical benchmarks from philosophers Michel Foucault and Georgio Gamben. The adopted methodological procedure here consists of bibliographic analysis and is centered upon the books In defense of society and The birth of Biopolitics, by Foucault, and Homo sacer, the sovereign power and the naked life, by Agamben. The fundamental question examined is about the possibilities of resistances to the new Constitution, and biopolitical powers, as far as natural life (bios), (vita nuda ), appropriated by new power relations of Biopolitics, is also one of the conditions to bring about Human Rights. The relevance of the above presented proposal is justified on the understanding that there is a change in the exercising and the feature of contemporary power, since the beginning of the XIXth century, which Foucault names Biopolitics, and has its performance through regulations much more than through Law, in line with the previous sovereign power system. The urgency and the need to reflecting on the present are critical for the understanding of contemporary powers as well as for thinking about methods of resistance to them, and Human Rights represent one of these tools. However, it is fundamental to study their limits, both of powers and resistances. The present research titled The limits of resistance and power in the relationship between human rights and Biopolitics, expresses a starting research, as a proposal for future developments. Therefore, it doesn‟t bring definitive and closed proposals, it just points to the limits of power and resistance between Human Rights and Biopolitics, always stressing the agonistic feature of this relationship.A investigação aqui proposta visa pensar os Direitos Humanos a partir da noção de Biopolítica, tendo como referenciais teóricos os filósofos Michel Foucault e Giorgio Agamben. O procedimento metodológico da pesquisa é de análise bibliográfica e terá como centro os livros Em defesa da sociedade e O nascimento da biopolítica, de Foucault, e Homo Sacer – o poder soberano e a vida nua I, de Agamben. A questão fundamental a ser analisada é sobre a possibilidade de resistências à nova constituição dos poderes biopolítico, na medida em que a vida natural (bíos), (vita nuda - vida nua), apropriada pelas novas relações de poder da biopolítica, é também uma das condições de surgimento dos Direitos Humanos. A importância da proposta acima apresentada se justifica por se compreender que há uma transformação no exercício e no caráter do poder contemporâneo a partir do Século XIX, que Foucault chama de Biopolítica, e que tem seu desempenho por intermédio muito mais pela normatização do que pela Lei, como no regime anterior do poder soberano. A urgência e a necessidade de refletir sobre o presente são elementos fundamentais para a compreensão dos poderes contemporâneos para também se pensar as formas de resistência a eles, e os direitos Humanos são uma dessas resistências. Contudo, é fundamental analisar seus limites, tanto das resistências quanto dos poderes. A investigação proposta aqui com o título Os limites de resistência e poder na relação entre Direitos Humanos e Biopolítica se apresenta como uma pesquisa inicial como proposta para futuros desdobramentos. Portanto, não traz conclusões definitivas e estanques, mas somente aponta para os limites do poder e da resistência entre os Direitos Humanos e a Biopolítica, mas sempre enfatizando o caráter agonístico dessa relação
