Sex workers: the possibility of guaranteing labor rights under the view of professional regulation and the positioning of the Regional Work Court of the 4th Region

This dissertation has as its main object sex workers and the possibility of guaranteeing labor rights from the regulation of the profession and, once possible, as the Regional Labor Court of the 4th Region has faced the matter. It is known that prostitution is considered one of the oldest professions in the world. Given this, there are numerous situations to which these people are subjected, including the violation of rights arising from their sexual work. Thus, the present paper seeks to address the history of these workers by conducting a study of the possible labor rights that arise from the provision of services of a sexual nature. Addressing the issue of prostitution is truly difficult in view of the very nature of the sexual act, as it is ascertained through a cash payment, which disgusts the average morale of society. On the other hand, it becomes even more complex, since the subject involves from legal aspects to religious approaches. Indeed, society in general, for various reasons, is not yet shaped to understand prostitution as any profession, stripped of the strong moralistic burden, whose burden has been borne by sex workers for centuries. However, it’s possible to verify the possibility of regulating prostitution as a job. In the same way that the rendering of services of a sexual nature uses the body as a work tool, countless other occupations, considered as normal, make use of the body as a work tool. Even though there is still no legal provision that recognizes prostitution as a legal form of labor, several labor courts have been granting rights arising from the activity, such as the Regional Labor Court of the 4th Region. Among the guaranteed rights we can highlight the signature in the work card, vacation, thirteenth salary etc. In view of this, a broader Bill is needed, encompassing sex workers more broadly, such as the bill proposed in this dissertation. This paper is divided into three chapters. The first chapter addresses the historical aspects of sexual service provision activity to the present day, as well as a brief analysis of the fundamental rights inherent in sex workers. Already the second chapter enters the criminal aspect of prostitution, which is subdivided into four subchapters. The last chapter mentions prostitution and labor legislation, addressing the performance of the Labor Court, especially the Regional Labor Court of the 4th Region, and the application of Labor Law by virtue of this professional activity. Finally, after intense research on the subject, as an annex, a bill was proposed for sex workers. In terms of methodology, for the accomplishment of this research, the dialectical approach method and the monographic procedure method are used. The research aligns with the area of concentration of the Graduate Program in Law of the Federal University of Santa Maria, namely, “Emerging Rights in the Global Society”. In addition, it is related to the research line “Socio-biodiversity Rights: Development and Dimensions of Sustainability” which is linked to the same program, as this research addresses issues involving social sustainability focused on an emerging right.A presente pesquisa possui como objeto principal os trabalhadores do sexo e a possibilidade de garantir direitos trabalhistas a partir da regulamentação da profissão e, uma vez sendo possível, como o Tribunal Regional do Trabalho da 4ª Região tem enfrentado a matéria. Sabe-se que a prostituição é considerada uma das profissões mais antigas do mundo. Diante disso, inúmeras são as situações a que essas pessoas são submetidas, entre elas a violação de direitos advindo de seu labor sexual. Assim, o presente trabalho busca abordar a história desses trabalhadores, realizando um estudo dos possíveis direitos trabalhistas que decorrem da prestação de serviços de natureza sexual. Abordar a temática da prostituição é verdadeiramente difícil tendo em vista a própria natureza do ato sexual, uma vez que este é ascendido por meio de um pagamento em dinheiro, o que causa repugnância a moral média da sociedade. De outro modo, se torna ainda mais complexo, vez que a temática envolve desde aspectos jurídicos até enfoques religiosos. Deveras, a sociedade em geral, por diversas razões, não está, ainda, amoldada para compreender a prostituição como uma profissão qualquer, despida da forte carga moralista, cujo o fardo é suportado há séculos pelas pessoas profissionais do sexo. Contudo, é possível verificar a cristalina possibilidade de regulamentar a prostituição como sendo um trabalho. Da mesma forma com que a prestação de serviço de natureza sexual se utiliza do corpo como instrumento de trabalho, inúmeras outras ocupações, tidas como normais, fazem uso do corpo como ferramenta de trabalho. Mesmo ainda hoje não havendo uma previsão legal que reconheça a prostituição como uma forma legal de trabalho, diversos tribunais trabalhistas já vêm concedendo direitos decorrentes da atividade, a exemplo do Tribunal Regional do Trabalho da 4º Região. Dentre os direitos garantidos podemos destacar a assinatura na carteira de trabalho, férias, décimo terceiro salário etc. Diante disso se faz necessário um Projeto de Lei mais amplo, onde englobe os profissionais do sexo de maneira mais ampla, a exemplo do projeto que fora proposto nesta dissertação. O presente trabalho está dividido em três capítulos. O primeiro aborda os aspectos históricos da atividade de prestação de serviços de natureza sexual, até os dias atuais, bem como realiza uma breve análise dos direitos fundamentais inerentes aos profissionais do sexo. Já o segundo capítulo adentra ao aspecto penal da prostituição, estando este subdividido em quatro subcapítulos. O último capítulo faz menção a prostituição e a legislação trabalhista, abordando a atuação da Justiça do Trabalho, em especial do Tribunal Regional do Trabalho da 4ª Região, e a aplicação do Direito do Trabalho em virtude dessa atividade profissional. Por fim, após intensa pesquisa referente ao tema, em forma de anexo, foi proposta um projeto de lei para os trabalhadores do sexo. Em termos de metodologia, para a realização da presente pesquisa, utiliza-se o método de abordagem dialético e como método de procedimento o monográfico. A pesquisa alinha-se à área de concentração do Programa de Pós-Graduação em Direito da Universidade Federal de Santa Maria, qual seja, “Direitos Emergentes na Sociedade Global”. Ademais, relaciona-se com a linha de pesquisa “Direitos da Sociobiodiversidade: Desenvolvimento e Dimensões da Sustentabilidade” a qual está vinculada ao mesmo programa, pois a presente pesquisa enfrenta questões que envolvem sustentabilidade social com foco em um direito emergente
