A integração do direito brasileiro pelo mandado de injunção: perspectivas para o instituto no Brasil, em face da jurisprudência do Supremo Tribunal Federal

No. of bitstreams: 1 disserta__o___debora_pereira.pdf: 642661 bytes, checksum: a6d77ef385d60190b275c99a46b1809c (MD5) Previous issue date: 13A presente dissertação objetivou identificar as perspectivas para o mandado de injunção no Brasil, levando-se em consideração a jurisprudência do Supremo Tribunal Federal, e verificar a legitimidade do Supremo Tribunal Federal para integrar o ordenamento jurídico brasileiro, com efeito erga omnes, por meio do mandado de injunção, inclusive na hipótese de ausência de qualquer legislação versando sobre o direito constitucionalmente assegurado. Foram estudados o Pós-positivismo, o Estado Democrático de Direito, a nova Hermenêutica, as formas de integração do ordenamento jurídico brasileiro, as correntes doutrinárias sobre a decisão do mandado de injunção, a evolução da jurisprudência do Supremo Tribunal Federal em mandados de injunção, o princípio da divisão de Poderes e o princípio do acesso à Justiça. Verificamos que, no contexto atual, o papel do juiz deve ser repensado, pois a ele cabe aplicar os valores constitucionais ao caso concreto, independentemente da existência de legislação específica. Constatamos que a jurisprudência do Supremo Tribunal Federal em mandados de injunção é vacilante, já que após adotar a tese concretista geral em casos relativos ao direito de greve dos servidores públicos, o Supremo Tribunal Federal adotou a tese concretista individual em diversos casos relativos ao direito de aposentadoria especial. Concluímos que o acesso à Justiça só foi plenamente observado naqueles mandados de injunção em que o Supremo Tribunal Federal disse o direito no caso concreto, utilizando-se, para tanto, dos meios permitidos para a integração de lacunas, de modo que esses mandados de injunção devem ser os norteadores para os próximos julgamentos. Concluímos também que o fato de o Supremo Tribunal Federal colmatar a lacuna do ordenamento jurídico no caso concreto, em mandado de injunção, não fere a divisão de Poderes, na medida em que ele apenas viabiliza o exercício dos direitos constitucionalmente assegurados no caso concreto. Por outro lado, concluímos que não cabe ao Supremo Tribunal Federal conferir efeito erga omnes à decisão em mandado de injunção, sob pena de ferir o princípio da divisão de Poderes, considerando que a Constituição não lhe autorizou a elaborar normas gerais e abstratas por meio do mandado de injunção.This work aimed to identify the prospects for the writ of injunction in Brazil, taking into account the jurisprudence of the Supreme Court, and to verify the legitimacy of the Supreme Court to integrate the Brazilian legal system, with erga omnes effect, through the writ of injunction, even in case of absence of any legislation dealing on the constitutionally guaranteed right. We studied the Post-positivism, the Democratic State of Law, the new Hermeneutics, the forms of integration of the Brazilian legal system, the different doctrines on the writ of injunctions decision, the evolving jurisprudence of the Supreme Court in writ of injunction, the principle of division of Powers and the principle of access to Justice. We verify that, in the present context, the role of the judge should be reconsidered because it is his responsibility to apply the constitutional values to the case, regardless of the existence of specific legislation. We also verified that the jurisprudence of the Supreme Court in writ of injunction is shaky, because in cases concerning the right of public servant to strike was adopted the general concrete thesis, and after that, in cases concerning the right to special retirement it was adopted the individual concrete thesis. We concluded that access to Justice was completely observed only in those writs of injunction that the Supreme Court said the right in the case, using the allowed means for the integration of gaps, so those writs of injunction should be used as model for next trials. We also concluded that the fact that the Supreme Court integrates the gap in the case by deciding a writ of injunction does not injure the division of Powers, since the Supreme Court only allows the exercise of constitutionally guaranteed rights in the case. On the other hand, we concluded that the Supreme Court cant decide with erga omnes effect because it would injure the principle of division of Powers since the Constitution did not authorize the Supreme Court to develop general and abstract rules through writ of injunction
