Democratização do Poder Judiciário: a ouvidoria do Conselho Nacional de Justiça como instrumento de participação popular

No. of bitstreams: 1 disserta_ao_pos___a_ouvidoria_do_cnj_como_instrumento_de_participa__o__popular___ronaldo_pedron.pdf: 2449511 bytes, checksum: 13586fe8a81e1d953aead6091a57ee0f (MD5) Previous issue date: 29De acordo com o postulado de soberania popular e cidadania ativa presentes no estado democrático de direito, normatizado de forma inequívoca pela Constituição Federal de 1988, bem como numa série de normativas infraconstitucionais, o que se vê é uma crescente discussão em torno da real capacidade dos mais diversos grupos e cidadãos, serem reconhecidos (e se reconhecerem) como atores e autores, seja de forma direta ou representada, nos processos decisórios das políticas, bem como em todo seu ciclo, desde a deliberação, formulação, monitoramento e avaliação das políticas públicas. Aspecto central dessa temática refere-se à estrita relação entre a legitimidade das ações governamentais, não só pela correspondência entre seus resultados (esperados ou alcançados) e os objetivos de determinados programas governamentais, mas especialmente pelo grau de influência ou participação da sociedade civil organizada, ou mesmo de indivíduos. Se a discussão sobre democracia participativa e seus déficits de legitimidade revelam-se ainda bastante pertinentes e atuais em relação aos Poderes Legislativo e Executivo, o que dizer da democracia participativa no Poder Judiciário? Um Poder reconhecido por ser tradicionalmente hermético, fechado, e que não raro, buscou no princípio da imparcialidade, fundamento para esse distanciamento. Como tornar sua gramática de funcionamento mais inteligível e sua gestão mais permeável ao cidadão? Como colocá-lo, à luz do controle e participação necessários numa democracia participativa, ao escrutínio da população? Essas inquietações constituem o fio condutor dessa dissertação. Vislumbra-se aqui um papel de mediação a ser exercido pelas Ouvidorias, ao atuarem como meio para o diálogo entre o cidadão e os órgãos da Justiça, visando encontrar soluções que sejam exequíveis, para os órgãos envolvidos, e que atendam aos interesses do cidadão e da sociedade. Institucional e normativamente, essa tarefa é atribuída às Ouvidorias judiciais, que se identificam com o lócus primordial de interlocução do cidadão com a administração da justiça. Mas a pergunta central reside em se verificar se e como esse papel vem sendo desempenhado. E qual o potencial para, nos dizeres de Boaventura de Souza Santos, elas se constituem em mecanismos de democratização (alteridade) do Poder Judiciário. How to put it, the light control and participation needed in a participatory democracy, the scrutiny of the population. These concerns are the leitmotif of the proposed project. glimpsed here a mediation role to be played by the Ombudsman, to act as a means for dialogue between citizens and the organs of justice, aimed at finding solutions that are, to the organs involved, achievable, and that meet the interests of the citizen and society. Institutional and normatively, this task is assigned to the judicial ombudsman, who identify with the primary locus of citizen dialogue with the administration of justice. But the central question lies in checking whether and how this role has been played. And what is the potential to, in Bonaventure's sayings, they constitute democratic mechanisms (otherness) of the Judiciary. And how dialogically this discussion or construction settle, not only new rights but also the very notion of emancipation, citizenship and social justice
