Estado, poder e liberdade: Uma reflexão a partir dos culturalismos de Nelson Nogueira Saldanha e Joaquim Carlos Salgado

No. of bitstreams: 1 minha_disserta__o_final.pdf: 1745900 bytes, checksum: 1cbf0e095bc0f69cb5e21d73b32a082b (MD5) Previous issue date: 27A História (jusfilosófica) do Estado, no auto-revelar-se do Espírito em busca da sua liberdade, permite a constatação de que atual a Ordem Constitucional (a hodierna fase do Estado de Direito) aborda e aglutina as instituições jurídico-políticas concebidas tanto na Ordem Política (notadamente na Grécia antiga), quanto na Ordem Jurídica (nomeadamente na Roma clássica), já que são momentos de um mesmo processo históricocultural-dialético. Mais que uma simples justaposição dos institutos, ideias e valores, a Ordem Constitucional as institui de novos significados, suprassumindo-as, de modo a amoldálos a nova ordem, cuja marcante característica é a conciliação entre o poder e a liberdade. Para dar supedâneo jusfilosófico a este trabalho, são escolhidas as reflexões culturalistas propostas pelos jusfilósofos Nelson Nogueira Saldanha (e suas correspondentes ideias a respeito das exemplaridades clássicas, do homem, da história como suprassunção de negações, da cultura, das formas de governo) e Joaquim Carlos Salgado (com a edificação da Escola Jusfilosófica Mineira, a ideia de justiça, o sujeito de direito universal e o direito como maximum ético).The States (philosophical) History, in its self-revealing of the Spirit in search of its freedom, leads us to find that the current Constitutional Order (the Rule of Laws present phase) coalesces the juridical-political institutions conceived both in the Political Order (notably in ancient Greece), and in the Juridical Order (especially in classical Rome), since they are moments of the same historical-cultural-dialectical process. More than a simple juxtaposition of the institutes, ideas and values, the Constitutional Order creates them with new meanings, thus supplanting them in order to subordinate them to the new order, whose revealing characteristic is the conciliation between power and freedom. In order to give a philosophical sustenance to this work, the culturalist reflections proposed by Nelson Nogueira Saldanha (and his corresponding ideas about the classic exemplarities, man, History as suprasassumption of denials, culture, and forms of government) are chosen, as well as Joaquim Carlos Salgado (with the construction of the Escola Jusfilosófica Mineira, the idea of justice, the universal rights subject and the law as ethical maximum)
