STF e CrIDH : anistia dos crimes por motivação política no período da ditadura militar

At that time there was the installation of the military dictatorship of the right in the South America rights. Our country has some belated measures related to the transition process. The 1979 law, despite being considered the first step towards democratization of the country, has numerous flaws because of the strong military imposition. One aspect of Brazilian transitional justice which characterizes it, is to repair this recognition with respect to political persecution and not to the torturers, beginning on CF/88 in Article 8º of the ADCT, among other subsequent legislative measures, such as reentry the previous function, the incorporation of time for social security, other remedies with the Commission of Truth and Memory, Caravan of Amnesty etc. Some changes are observed, however our country is considered as the one in the region, unlike Argentina, for example, to adopt a position not evolved with regard to amnesty for political crimes of the military dictatorship of the 1970s, without adequately analyzing the Inter-American Court jurisprudence from Chile, Peru and Uruguay, in the matters related to the topic. This research, therefore, focuses primarily on an analysis of the following points: the formation of European and Brazilian national states, the importance of democracy in the evolution of national and international studies on the protection of human rights, globalization as an important way for greater interdependence and connection among countries, the need to expand and strengthen the study of issues related to the Inter-American System, in particular, control of conventionality, especially after the 1990s, when many countries had ratified both the American Conventions, as the jurisdiction of Inter-American Court, the study of transitional justice in Brazil and the changes that occur from the law nº 6.683/79. From this analysis, we may seek to ultimately present the impact of case Gomes Lund vs. Brazil (2010), after the trial of ADPF nº 153 correlating it with other jurisprudence of Inter- American Court of Human Rights, as well as, decisions and judgments, including those of Peru (2001), Chile (2006) and Uruguay (2011).A ditadura militar brasileira de 1964 foi um período de terríveis crimes contra o ser humano e a sua liberdade democrática, em nível nacional, contra os que eram considerados ameaças ao regime, os que defendiam ou comungavam com ideias socialistas e comunistas. Naquela época, houve a instalação da ditadura militar de direita na América do Sul. O nosso país possui algumas medidas tardias relacionadas ao processo de transição. A lei de 1979, apesar de ser considerada o primeiro passo para a redemocratização do país, tem inúmeras falhas em razão da forte imposição militar. Uma das dimensões da justiça transicional brasileira, que o caracteriza, consiste na reparação, este reconhecimento, com relação aos perseguidos políticos e não aos torturadores, teve início na CF/88 no artigo 8º do ADCT, dentre outras medidas legislativas posteriores, como, o reingresso a função anterior, a incorporação do tempo para a previdência social, outras formas de reparação com a Comissão da Memória e Verdade, Caravanas da Anistia, etc. Algumas mudanças são observadas, no entanto, o nosso país é considerado o único de sua região, ao contrário da Argentina, por exemplo, a adotar um posicionamento não evoluído no que diz respeito à anistia dos crimes políticos da ditadura militar da década de 1970, sem analisar de forma adequada as jurisprudências da Corte Interamericana, de forma diversa a: Chile, Peru e Uruguai, em assuntos relacionados ao tema. A presente pesquisa, portanto, concentra-se basicamente em uma análise dos seguintes pontos: a formação dos estados nacionais europeus e brasileiros, a importância da democracia na evolução dos estudos nacionais e internacionais relativos à proteção dos direitos humanos, a globalização como marco importante para uma maior interdependência e conexão entre os países, a necessidade de ampliar o estudo e o fortalecimento dos assuntos relacionados ao sistema interamericano, em especial, o controle de convencionalidade, sobretudo após a década de 1990, quando muitos países já haviam ratificado tanto a Convenção Americana quanto a jurisdição da CrIDH, o estudo da justiça de transição no Brasil e as modificações que ocorrem a partir da lei nº6.683. Através desta análise, procura-se, afinal, apresentar a repercussão do caso Gomes Lund versus Brasil (2010), após o julgamento da ADPF nº153, correlacionando-o com outras jurisprudências da CrIDH e casos, entre os quais as do Peru (2001), Chile (2006), e Uruguai (2011)
