THE GRANT OF WATER USE OF SUPERFICIAL WATER RESOURCES IN RIO GRANDE DO SUL: CONTRIBUTIONS TO ITS REFINEMENT.

Water scarcity is one of the main problems the world will have to deal with in the twentiethfirst century. The great current challenge is to attend to the increasing water demand and, parallely, preserve the resource which will be scarce. The Grant of water use can be one way of solving these matters. It is of the tools for the management of water resources due to the federal legislation, according to the 9.433/1997 law. The grant can be defined as an instrument through which public power awards a public or private being the right of using water resources, considering the quantity, the quality, the purpose of use and the period to be used. In the state of Rio Grande do Sul, the legislation of Grant was approved in 1994 according to the state law number 10.350. However, the instrument, which presents a number of deficiencies, was established in 1999 by the Department of Hydric Resources of the State Secretary of Environment. Considering this context, the present study makes a critical analysis of the process of grant of water use in the state of Rio Grande do Sul through the systematization of the current proceedings for the grant, the analysis of the legal aspects, the comparison of this process in this state and other states in Brazil, identifying its fragilities and making suggestions for its improvement.A escassez da água é um dos principais problemas que o homem terá que enfrentar no século XXI. O grande desafio atual é atender à crescente demanda de água, e, ao mesmo tempo, preservar o recurso que tende à escassez. A outorga de direito de uso de recursos hídricos pode ser um dos meios para solucionar essas questões. A outorga é um dos instrumentos de gestão de recursos hídricos, prevista na Legislação Federal, conforme Lei Federal nº 9.433/1997, podendo ser definida como um instrumento em que o poder público confere o direito de uso do recurso a um ente público ou privado, considerando a quantidade, qualidade, a finalidade de uso e o tempo a ser utilizado. No estado do RS, a legislação referente à outorga foi aprovada no ano de 1994 de acordo com a Lei Estadual nº 10.350. No entanto, o instrumento começou a ser implantado, de fato, no ano de 1999 pelo Departamento de Recursos Hídricos da Secretaria Estadual do Meio Ambiente e apresenta uma série de deficiências. Dentro desse contexto, o presente estudo realiza uma análise crítica do processo de outorga de direito de uso de recursos hídricos no RS, por meio da sistematização do procedimento atual da outorga, da análise dos aspectos legais, da comparação com alguns estados da Federação, identificando assim sua fragilidade e apontando sugestões para sua melhoria
