The theoretical framework is the access to Justice Movement, understood as the right and fundamental guarantee of access to all legitimate means - jurisdictional and extra-jurisdictional - of protection and of rights implementation. Structural litigation is related to constitutional values which have not been consolidated, and demands, for its solution, the reform of bureaucratic and social structures through the creation or correction of public policies. The study points out some problems faced by adjudication to present effective responses to this kind of complex and multipolar conflicts. Consensual methods of dispute resolution are presented as important instruments to contribute to the production of effective results for structural change. The hypothesis defended is that the Public Prosecution, in view of its role as a guarantee of access to Justice and as a social transformation agent in order to consolidate the founding values of the democratic State of law, has the essential requirements to act as the protagonist in obtaining consensus for the extra-jurisdictional solution of the structural litigation. However the resolutive adjustment must be lead by parameters, extracted from the constitution, that promote the legitimacy and effectiveness of the consensual solution. In the conclusion of this research some measures are proposed in order to enhance the organic and functional management of the Public Prosecution, for the treatment of complex situations, such as structural conflicts.Esta pesquisa tem por objetivo discutir o papel do Ministério Público para o tratamento adequado dos litígios estruturais. Constitui marco teórico o movimento de acesso à Justiça, compreendido como direito e garantia fundamental de acesso a todos os meios legítimos – jurisdicionais e extrajurisdicionais – de proteção e de efetivação de direitos. Os litígios estruturais são conflitos coletivos que se relacionam a um valor constitucional não concretizado, e demandam, para sua solução, a reforma de estruturas burocráticas e sociais, mediante a implementação ou a correção de políticas públicas. A pesquisa aponta alguns problemas enfrentados pela tutela jurisdicional por adjudicação para apresentar respostas efetivas a essa espécie de conflitos complexos e multipolares. Apresentam-se os métodos autocompositivos como recursos importantes para contribuir com a produção de resultados efetivos para a mudança estrutural. A hipótese defendida é que o Ministério Público, em razão do seu papel de garantia de acesso à Justiça e de agente de transformação social para a concretização dos valores fundantes do Estado democrático de direito, ostenta os requisitos necessários para atuar como protagonista na obtenção de consensos para a solução extrajurisdicional dos litígios estruturais. Deve orientar sua atuação resolutiva, entretanto, por parâmetros, extraídos da conformação constitucional da instituição, que promovam a legitimidade e a efetividade da solução consensual. Como resultado da pesquisa, propõem-se algumas medidas para o aprimoramento da gestão orgânica e funcional do Ministério Público, para o tratamento de situações complexas, como os conflitos estruturais
