Firstly, the article demonstrates the wrong view of the doctrine of irregular situation. It explains how this view has been overcome by the new paradigm of the doctrine of full protection for child and adolescent, and the respect to human and fundamental rights within the Legal Democratic State. Secondly, the article relies on Constitutional law and Child and Adolescent Statute in order to analyze the new law as a warranty network, thus guaranteeing and validating its human-ethical content, efficiency and efficacy. Integral Protection Doctrine.A primeira parte deste afazer tem o escopo de demonstrar a visão equivocada da doutrina da situação irregular e sua superação pelo novo paradigma da doutrina da proteção integral da criança e do adolescente, a partir do respeito aos direitos humanos e fundamentais do Estado Democrático de Direito. A segunda, com apoio no Direito Constitucional e no Estatuto da Criança e do Adolescente, analisa esse novo direito como uma rede de garantias, sob a ótica garantista de validade pelo seu conteúdo ético-humano e pela sua eficiência e eficácia.
