A SEMIOLOGIA DO PODER E O HOMEM SIMBÓLICO: REFERENTES PARA UMA (RE) AVALIAÇÃO DO DIREITO

The Law, understood as product and at the same time source of culture. Establishes ways of communication that modify themselves in everyday subjective interaction. Such ways of cultural communication are not always perceived by the Law itself which creates false representations of social life. Because of this, it is important to establish the necessary mechanisms to look for the principles that base the law discourse in it normative aspect. This work will be done by the Semiology of Power, by the meaning of the Symbolic Man and by the Philosophy of the Ordinary Language. The methodology that guides this work has as main objective to check if the categories Semiology of Power and Law make a discourse that includes everyday language; and as specific objectives: a) formulating some considerations about Law Science as a phenomenon of culture; b) considerating as categories the Semiology of Power, Phylosophy of Ordinary Language and Symbolic Man as idea of building for an authentic Law understood as the one which analyses the ideological charges of a law discourse. The methodological criteria used to carry on such reflection is the inductive method. Key words: Semiology of Power. Symbolic Man. Language. Law.O Direito, percebido como produto e ao mesmo tempo fonte de cultura, estabelece formas de comunicação que se modificam nas interações subjetivas do cotidiano. Essas formas de comunicação culturais nem sempre são percebidas pelo próprio Direito, engendrando falsas representações da vida social. Por esse motivo, é preciso estabelecer os mecanismos necessários para se procurar os fundamentos que embasam o discurso jurídico em seu aspecto normativo. Este trabalho será concretizado pela Semiologia do Poder, pelo significado do Homem Simbólico e pela Filosofia da Linguagem Ordinária. As providências metodológicas para delinear o trabalho têm por objetivo geral investigar se as categorias Semiologia do Poder e Direito concretizam a elaboração de um discurso que contemple a linguagem do cotidiano; e como objetivos específicos: a) formular considerações acerca da Ciência Jurídica como um fenômeno de cultura; b) considerar as categorias Semiologia do Poder, Filosofia da Linguagem Ordinária e Homem Simbólico como a idéia de construção para um Direito legítimo entendido como aquele que analisa as cargas ideológicas do discurso jurídico.
