LEGISLAÇÃO AMBIENTAL: ASPECTOS LEGAIS, CRÍTICOS E PROPOSIÇÕES FRENTE À REALIDADE DA NASCENTE DO RIBEIRÃO ANICUNS

For that, we used the data of another research in healthcare, simultaneously developed, in which 24 water and sediment samples were collected along the same watershed in August 2006, during drought period in the region. Multi- elementary chemical analyses were accomplished in these samples. From these 24 samples one was separated, the nearest from Anicuns watershed headwater, so that we could verify if the headwater has already been reached by the pollution. Chemical elements concentration results were not found in lab analysis. The problem refers to the fact that although the population knows that the watershed is polluted, due to the sludge and the strong scent it is still used as crops and orchards irrigation, which compromises the health care population living in the watershed. And this is due to the lack of an efficient State public neighborhood planning, as especially of the non enforcement of environmental legislation.O presente trabalho teve como objetivo verificar a eficácia da Legislação Ambiental frente à realidade da nascente do Ribeirão Anicuns, no município de Goiânia GO, Brasil, para que através deste estudo possa ser feita uma reflexão dos nossos instrumentos de aplicação da Lei, verificando se esta está atingindo o seu objetivo que é a proteção do meio ambiente e da sociedade. Para o alcance de nosso objetivo, utilizamos dados de outra pesquisa na área da saúde, desenvolvida simultaneamente, a qual coletou ao longo do mesmo Ribeirão 24 amostras de água e sedimento de corrente, no período de seca, agosto de 2006. Foram realizadas análises químicas multielementares nestas amostras. Destas 24 foi retirada uma, a mais próxima a nascente do Ribeirão Anicuns para que pudéssemos constatar se a nascente do Ribeirão já foi atingida pela poluição. Não foram encontrados resultados de concentrações dos elementos químicos nas análises laboratoriais. A problemática refere-se ao fato de que o Ribeirão apesar da população saber que é poluído, devido ao forte odor ainda é utilizado como irrigação de hortas e pomares, o que coloca em risco a saúde da população ribeirinha. E tudo isso tem início a falta de planejamento por parte do poder público na estruturação do setor, como principalmente da não aplicação da Legislação Ambiental
