Normas em movimento: : monogamia e poliamor no contexto jurídico brasileiro

Since 2012, with the registration of the first ‘polyaffective’ civil union, in Tupã (São Paulo, Brazil), there was an intense debate in the legal environment and the media regarding the legality and morality of polyamory. Taking this case as a reference, this paper analyzes controversies related to the recognition of forms of conjugality and family that differ from the model based on monogamy and heterosexuality. Its objective is to investigate how monogamy, as well as non-monogamous arrangements, have been treated in different historical contexts in the Brazilian legal system, highlighting the impact of the concept of ‘polyaffectiveness’ in this debate. It is argued that mononormativity is not a fixed, homogeneous and ahistorical reality, as it is not an absolute and insuperable principle, but contextual, performative and uncertain, being the object of agency and dispute. In this sense, the emergence of the legal debate on polyamory contributed, paradoxically, to reproduce and update the monogamous norm, putting it back into discourse to reinforce it, but also to displace it, highlighting the controversy surrounding the idea that families only exist in dyadic and exclusive conjugal relationships.A partir de 2012, com o registro da primeira escritura pública de união poliafetiva do Brasil, em Tupã (São Paulo), instaurou-se um intenso debate no meio jurídico e na mídia a respeito da legalidade e moralidade do poliamor. Tomando esse caso como referência, o presente trabalho analisa controvérsias relacionadas ao reconhecimento de formas de conjugalidade e família que se diferenciam do modelo baseado no casamento monogâmico e heterossexual. O objetivo é investigar como a monogamia, assim como os arranjos não-monogâmicos, têm sido tratados em diferentes contextos históricos no sistema jurídico brasileiro, destacando o impacto do conceito de “poliafetividade” nesse debate. Argumenta-se que a mononormatividade não é uma realidade fixa, homogênea e ahistórica, pois não se trata de um princípio absoluto e intransponível, mas contextual, performativo e incerto, sendo objeto de agenciamentos e disputas. Nesse sentido, a emergência do debate jurídico sobre poliamor contribuiu, paradoxalmente, para reproduzir e atualizar a norma monogâmica, recolocando-a em discurso, de modo a reforçá-la, mas também deslocá-la, evidenciando a controvérsia existente em torno da ideia de que só há família em uma relação conjugal diádica e exclusiva
