Tinjauan Yuridis Sosiologis Terhadap Tindakan Main Hakim Sendiri (eigenrichting) yang dilakukan oleh Massa Terhadap Pelaku Pencurian (Studi Kasus di Wilayah Hukum Polres Kabupaten Pasuruan)

This research is motivated by the phenomenon of vigilantism that occurs in Pasuruan Regency. Vigilante action (eigenrichting) is an act committed by individuals or groups against perpetrators of crimes to provide a deterrent effect. Vigilante action is one form of misconduct against legal procedures that apply in Indonesia which if we review normatively have no justification so that the action can not be legally justified. This study uses a juridical – sociological approach with qualitative methods. The primary data source was taken through an interview with pasuruan community and members of the State Police of the Republic of Indonesia Resort Pasuruan Regency while the secondary data source was obtained by conducting literature studies. Based on the results of the study, the factors that cause vigilante acts are divided into 2 factors, namely internal factors such as anger and external factors such as rampant crime, public distrust of the police, and law enforcement inequality. The community argues that vigilante actions are a form of deviation to law enforcement in Indonesia that has no reason to be right in positive law. As for the countermeasures carried out by the Pasuruan Regency Police there are 2 efforts, namely: penal (litigation approach, approach that is repressive and carried out after the occurrence of a crime event) and non-penal (non-litigation approach, preventive approach)
