بررسی کاربردی مفاهیم جرم‌شناسی با تأسی از یافته‌های حقوق شهروندی در قانون آیین دادرسی کیفری

Background and Aim: Inefficient performance of criminal justice system in dealing with criminal phenomena, inefficiency of common criminological solutions in discussing the etiology of crime and non-respect of citizens’ rights, provided a suitable platform for providing critical views in the field of criminology in protest of the current situation and institutions of criminal justice. The main causes and factors of crime should be sought not in the offender and his environment, but in the unequal and discriminatory structure of society. The unequal structure in society ignores citizens’ rights and leads them to crime. The purpose of this article is to apply the concepts of criminology in the Code of Criminal Procedure based on the teachings of citizenship rights and we try to legislate effective criminological theories to eliminate gaps and shortcomings with the help of criminological findings and to legislate the rights of litigants by using these findings. Materials and Methods: Our method in this article is descriptive-analytical using library resources. Findings: The Code of Criminal Procedure through the formulation and approval of existing regulations, including serious attention to the judicial process and avoidance of the criminal process and reform and improve the performance of this system, based on the findings of citizenship rights and through the use of alternative strategies in various mechanisms such as the agreement on restorative justice and greater respect for the citizens’ rights, in addition by providing a special procedure for children and adolescents, as well as the adoption of a special procedure for legal entities distinct from natural persons, reflects the teachings of criminology. Conclusion: Despite the recognition of new rights for the victim, the Iranian legislature faces with deficiencies such as the lack of explicit identification of legal persons as victims, the disregard for the victim's right to a lawyer during the investigation, not benefiting of adequate medical and psychological care and support, and the lack of enforcement guarantees for violations of citizenship rights.   Please cite this article as: Hashemzadeh SA, Aghaei Jannat Makan H, Rajabiyeh MH. Bioethics Journal, Special Issue on Citizenship Rights, Autumn 2018; 315-330.زمینه و هدف: عملکرد ناکارآمد نظام عدالت کیفری در زمینه مقابله با پدیده مجرمانه، عدم کارایی راهکارهای جرم‌شناسی رایج در بحث علت‌شناختی جرم و عدم رعایت حقوق شهروندان، بستر مناسبی برای ارائه نظریات انتقادی در حوزه جرم‌شناسی در اعتراض به وضع کنونی جامعه و نهادهای عدالت کیفری فراهم آورده است. علل و عوامل اصلی وقوع جرم را نه در شخص مجرم و محیط پیرامون او، بلکه در ساختار نابرابر و تبعیض‌آمیز جامعه باید جستجو کرد. ساختار نابرابر در جامعه حقوق شهروندان را نادیده می‌گیرد و آن‌ها را به سمت جرم و جنایت سوق می‌دهد. هدف ما در این مقاله کاربست مفاهیم جرم‌شناسی در قانون آیین دادرسی کیفری با تأسی از آموزه‌های حقوق شهروندی است و می‌کوشیم تا با تقنین نظریه‌های کارآمد جرم‌شناسی خلأ‌ها و نواقص موجود را به کمک یافته‌های جرم‌شناسی رفع کنیم و برای تقنین حقوق اصحاب دعوا از این یافته‌ها نهایت استفاده را ببریم. مواد و روش‌ها: روش ما در این مقاله به شکل توصیفی ـ تحلیلی و با استفاده از منابع کتابخانه‌ای می‌باشد. یافته‌ها: قانون آیین دادرسی کیفری از رهگذر تدوین و تصویب مقررات موجود، از جمله توجه جدی به فرایند قضازدایی و دوری از فرآیند کیفری و اصلاح و بهبود عملکرد این نظام، با تأسی از یافته‌های حقوق شهروندی و از طریق به کارگیری راهکارها و راهبردهای جایگزین در قالب سازوکارهای متعدد و متنوع همچون توافقی‌شدن عدالت ترمیمی و احترام بیشتر به حقوق شهروندان، به علاوه با پیش‌بینی آیین دادرسی ویژه اطفال و نوجوانان و همچنین اتخاذ سیستم دادرسی ویژه برای اشخاص حقوقی متمایز از اشخاص حقیقی به نوعی انعکاس آموزه‌های جرم‌شناسی را در بستر خود نشان می‌دهد. نتیجه‌گیری: قانونگذار ایرانی با وجود شناسایی حقوق نوین برای بزه‌دیده، هنوز هم با نارسایی‌هایی مانند عدم شناسایی صریح اشخاص حقوقی به عنوان بزه‌دیده، نادیده‌گرفتن حق داشتن وکیل تسخیری برای بزه‌دیده در مرحله تحقیقات، بهره‌مندنشدن بزه‌دیده از مراقبت و حمایت پزشکی و روانی مناسب و فقدان ضمانت اجرایی بایسته در قبال نقض حقوق شهروندی پیش‌بینی‌شده برای آنان، رو به رو است
