مشروعیت تصرف ذی‌نفعان بالقوه در اموال بیمار مشرف به مرگ

Background and Aim: allowing or not allowing legal possessions is a description of a situation that is sometimes due to the intrinsic and personal characteristics and sometimes due to the subjects with respect to individuals. Although the dying patient’s condition arises from an intrinsic description, but this condition causes his property to be in a situation where the concern of legal possessions assessment of the potential beneficiaries of the post-death period has spread to the pre-death period, and this poses a serious challenge. In simpler terms, since it often happens that the heirs of the dying patients do not have the financial means to manage their own affairs or theirs patient, can we extended the definite competence after the death of the beneficiaries to the pre-death period or depict a minimum of allowing of possession of the patient's property on the basis of ownership participation? Materials and Methods: This descriptive-analytical research examines the ruling of the possession of potential beneficiaries in dying patient's property in the pre-death period by analyzing jurisprudential and legal texts. Conclusion: It is possible to depict a special face of ownership in accordance with the dignity of the heir or other persons or at least to assess the influence of their suspended and preoccupied possessions in the pre-death period; however, the scope of such possession requires an analysis of the evidence and the artificial order of the legislator. Of course, all of these solutions are subject to an exclusionary (or restrictive) constraint, so there is not difference between these persons’ possession and others’ rights. Med Ethics J 2020; 12(42): e11.زمینه و هدف: اباحه یا عدم اباحه تصرفات حقوقی، وصف وضعیتی است که گاه ناشی از ویژگی‌های درون ذاتی و شخصی اشخاص است و گاه برگرفته از موقعیت موضوعات نسبت به اشخاص می‌باشد. وضعیت بیماری مشرف به موت اگرچه برخاسته از وصف درون ذاتی است اما همین وضعیت سبب می‌گردد تا اموال او در موقعیتی قرار گیرد که دغدغه امکان سنجی تصرفات حقوقی اشخاص صاحب حقِ دورۀ پس از فوت، به دورۀ پیش از فوت سرایت کرده و همین امر مسئله را با چالشی جدی رو‌به‌رو می‌کند. به ‌بیانی ساده‌تر، از آنجایی که بسیار اتفاق می‌افتد که ورثۀ بیماران مشرف به موت توان مالی برای اداره امور خودشان یا بیمار را ندارند آیا می‌توان اهلیت قطعی پس از فوت صاحبان حق را به دورۀ پیش از موت نیز سرایت داد و یا حداقلی از اباحۀ تصرف در اموال مریض را به اعتبار مشارفت در مالکیت به تصویر کشید؟ مواد و روش‌ها: این جستار که با روش توصیفی تحلیلی و با واکاوی متون فقهی و حقوقی انجام شده، حکم تصرفات صاحبان بالقوۀ حق در اموال بیمار مشرف به موت در دورۀ پیش از موت را بررسی می‌کند. نتیجه‌گیری: می‌توان ثبوتاً چهره‌ای خاص از مالکیت شأنی برای ورثه یا موصیله یا اشخاصی از این دست، به تصویر کشید و یا لااقل، نفوذ تصرفات معلق و منجز ایشان در دورۀ پیش از مرگ را امکان‌سنجی نمود، هرچند که محدودۀ این قبیل تصرفات، نیازمند واکاوی در ادلۀ اثباتی و نظم تصنّعی شارع یا مقنن است؛ البته که تمامی این راه‌حل‌ها مقید به یک قید احترازی و تعلیلی (یا تقییدی) است و آن، عدم منافات تصرفات این اشخاص با حقوق سایرین است. وصف تزلزل در مالکیت شأنی- اگر قائل بدان شویم- نیز ریشه در همین قید دارد
