DERECHO DE REPRESENTACIÓN EN LOS PROCESOS SUCESORIOS

The right of representation is a social institution that is based on protecting the lineage.  It has been our objective to explain how the right of representation in Panamanian law is regulated and to create doctrine, so that this institute is fully included in the succession processes tested for by the social character of the right of representation.     In general, the right of representation is fully regulated in the succession processes deferred by law; not so, in probate succession processes.  The methodology was mainly based on code review. We review the codes of some laws that descend from the Napoleonic code: Chilean, Argentine and Colombian; the Spanish, Italian, Cuban and other code was also revised.  The right of representation is the legal power of certain heirs to collect the inheritance that their father, mother or brother did not want or was unable to collect, usually for reasons beyond his or her own business.  While it is true that doctrinally and jurisprudence and in a very subtle way, the right of representation has been incorporated into probate processes (see judgment of 13 of 4 February 1999), it is also true that a law is required that directly protects the right of representation in the pre-death, and that article 781 of our Civil Code be partially a modified, in order for the right of representation to be incorporated into the pre-death. We conclude this investigation with a proposal to declare article 781 of the Civil Code unconstitutional with regard to pre-death in the succession processes tested.El derecho de representación es una institución de carácter social que tiene como fundamento proteger la estirpe.  Ha sido nuestro objetivo exponer cómo está regulado el derecho de representación en la legislación panameña y crear doctrina, a fin de que este instituto sea recogido en su totalidad en los procesos sucesorios testados por el carácter social que tiene el derecho de representación.     En general el derecho de representación está plenamente regulado en los procesos sucesorios deferidos por la ley; no así, en los procesos sucesorios testamentarios.  La metodología se basó fundamentalmente en la revisión de códigos. Revisamos los códigos de algunas legislaciones que descienden del código napoleónico: el chileno, argentino y colombiano; también se revisó el código español, el italiano, el cubano y otros.  El derecho de representación es la facultad legal que tienen ciertos herederos de recoger la herencia que su padre, madre o hermano no quiso o no pudo recoger, generalmente por causas ajenas a éste.  Si bien es cierto que doctrinal y jurisprudencialmente y de manera muy sutil, el derecho de representación ha sido incorporado en los procesos testamentarios (ver sentencia 13, de 4 de febrero de 1999), también es cierto que se requiere una ley que directamente proteja el derecho de representación en la premuerte, y que se modifique parcialmente el artículo 781 de nuestro Código Civil, a fin de que sea incorporado el derecho de representación en la premuerte. Terminamos esta investigación con una propuesta para que se declare inconstitucional, parcialmente, el artículo 781 del Código Civil en lo que respecta a la premuerte en los procesos sucesorios testados
