The clerk’s register of the Carcassonne Inquisition, for the years 1249-1258, tells us a different way of proceeding against heretics, compared to the one known by the register of Jacques Fournier or by the Sentences of Bernard Gui. Even though they had the necessary means to lead an investigation, to impose a preventive detention, to receive a full confession, to sentence or to modify penalties, the judges usually released the accused on bail guaranteed by the fidejussors. They required from the accused an oath to submit themselves to the imposed penance. This system made the accused obliged beforehand to consent to his future penance.
