The impact of European Prison Rules on living conditions in French prisons

La prison a longtemps constitué une zone d’ombre. Aujourd’hui, de nombreux regards se portent sur elle, favorisant la reconnaissance et l’évolution des droits positifs de la personne incarcérée qui ne cessent de s’étendre et de se généraliser à l’heure où la problématique du droit des détenus fait partie intégrante du cadre général du respect des droits de l’Homme. C’est sous l’influence concrète des Règles pénitentiaires européennes qui ont emporté l’adhésion des États membres de l’Union européenne que la privation de liberté s’est ouverte au champ du droit et au « monde extérieur », offrant de nouvelles perspectives aux droits individuels et processuels du détenu en vue de garantir l’effectivité d’une détention dans le respect des droits fondamentaux. Au-delà, les Règles pénitentiaires européennes ont permis un changement de paradigme de la part de l’administration pénitentiaire qui a su se saisir des prescriptions européennes pour en faire un levier stratégique d’évolution. L’un des facteurs dynamiques de cette évolution est incontestablement lié au renforcement des contrôles extérieurs dont l’administration fait l’objet ces dernières années, qu’ils soient juridictionnels ou institutionnels. Notre ordre juridique fait toutefois preuve de multiples faiblesses en réduisant la portée de certaines Règles ou en se plaçant en contradiction manifeste avec les prescriptions européennes. Dans un contexte où les choix politiques en matière pénale, l’orientation budgétaire principalement axée sur la sécurisation des établissements pénitentiaires, mais aussi les attentes sociales, influent fortement sur la conduite et le fonctionnement de l’administration pénitentiaire, il importait de dresser un état des lieux rigoureux et objectif, ouvrant le champ à des pistes de réflexion, en vue de déterminer, pour l’avenir, les grandes orientations de la politique pénitentiaireThe prison has long been a greg area. Today, many eyes are focused on it, promoting the recognition and evolution of the positive rights of the imprisoned person which continue to expand and become generalized at a time when the issue of prisoners' rights is part of the integral part of the general framework of respect for human rights. It is under the concrete influence of the European Prison Rules which won the support of the Member States of the European Union that the deprivation of liberty opened up to the field of law and to the "outside world", offering new perspectives to the individual and procedural rights of the detainee in order to guarantee the effectiveness of a detention while respecting fundamentalrights. Beyond that, the European Prison Rules have enabled a paradigm shift on the part of the prison administration, which has been able to seize on European prescriptions to make them a strategic lever for development. One of the dynamic factors in this development is undoubtedly linked to the strengthening of external controls to which the administration has been subject in recent years, whether judicial or institutional. However, our legal order shows multiple weaknesses by reducing the scope of certain Rules or by placing itself in clear contradiction with European prescriptions. In a context where political choices in penal matters, the budgetary orientation mainly focused on the security of penitentiary establishments, but also social expectations, strongly influence the conduct and functioning of the penitentiary administration, it was important to draw up a report rigorous and objective places, opening the field to avenues of reflection, with a view to determining, for the future,the main orientations of prison policy
