Initialement conçue comme une technique d’organisation territoriale de l’État unitaire, la décentralisation produit des effets sur l’ensemble du système juridique unitaire. Partant d’une dimension tripartite de la décentralisation (objet, fonction, sujet), cette approche permet de rendre compte de l’évolution des relations entre l’État et les collectivités. C’est ainsi que la décentralisation territoriale fait évoluer le droit unitaire de l’État.
