Public accounts of the presidents, state governors and municipal mayors: exam by the Brazilian courts of auditors

Na escala e complexidade das comunidades atuais, é inevitável a adoção da representação. Nesse contexto, como os governos são exercidos por mulheres e homens limitados, são necessários controles que os incentivem a agir no interesse dos governados, reduzam a assimetria de informação entre o governo e os cidadãos e desencorajem a corrupção. Assim, nas democracias representativas contemporâneas, exige-se que os governantes se sujeitem à accountability, tanto perante os cidadãos como ante outras instituições. A fiscalização financeira e orçamentária é tradicional incumbência dos parlamentos, que atualmente a dividem com as instituições superiores de controle. No Brasil, os chefes de Poder Executivo devem prestar contas, referentes ao exercício anterior, para serem apreciadas pelos tribunais de contas, que emitem pareceres prévios, e julgadas pelo Poder Legislativo. Conquanto a importância da apreciação dessas contas seja reiteradamente exaltada, os resultados desse processo frustram expectativas, observa-se atraso metodológico na atividade e há limitada produção científica sobre seu desempenho. É tal apreciação o objeto desta pesquisa, cujo objetivo é esquadrinhar a inter-relação entre as normas constitucionais que instituem o sistema de accountability contábil, financeira, orçamentária, operacional e patrimonial, no que concerne aos governantes, e as normas de integração desse sistema. Nela, pretende-se descobrir como deve ser realizada a apreciação, pelos tribunais de contas do Brasil, das contas prestadas por presidentes da República, governadores de estado e do Distrito Federal e prefeitos municipais, e se a legislação infraconstitucional, relacionada a essa apreciação, atende normativamente ao exigido pelo sistema constitucional de accountability. Realiza-se pesquisa bibliográfica e documental, principalmente, legislativa, abrangendo a legislação nacional, federal, estadual e municipal. Para exame da legislação municipal, seleciona-se amostra probabilística representativa dos municípios brasileiros. Trata-se de pesquisa normativa, que não investiga se a prática diária de apreciação das contas dos governantes cumpre o que estabelece a legislação. A pesquisa não aborda o julgamento das contas nos parlamentos, nem a possibilidade de impugnação no âmbito do Poder Judiciário. Não se realiza pesquisa historiográfica ou comparativa. Como contribuição à ciência jurídica nacional, demonstra-se como o sistema de accountability contábil, financeira, orçamentária, operacional e patrimonial, instituído pela Constituição de 1988, exige que as contas dos presidentes da República, governadores e prefeitos sejam prestadas e apreciadas. Demonstra-se, também, que, em muitas questões relevantes, o conjunto normativo não atende aos requisitos estipulados pela estrutura básica constitucional, em alguns casos por omissão do legislador infraconstitucional, noutros casos porque as normas postas estão em franco desacordo com o sistema constitucional. Finalmente, a pesquisa mostra como corrigir a legislação e suprir as omissões legislativas. Desse modo, o trabalho pode aperfeiçoar o conjunto normativo e qualificar a apreciação das contas dos chefes de Poder Executivo. Pelo exposto, as contribuições apresentadas ajudam a fortalecer a accountability horizontal e vertical no país e, em consequência, a aprimorar a democracia representativa brasileira.In the scale and complexity of today\'s communities, the adoption of representation is inevitable. In this context, as governments are exercised by limited women and men, controls are needed to encourage them to act in the interests of the governed ones, to reduce information asymmetry between government and citizens, and to discourage corruption. Thus, in contemporary representative democracies, rulers are required to submit themselves to accountability, both to citizens and to other institutions. Financial and budgetary control is traditionally a task of parliaments, which currently shares it with supreme audit institutions. In Brazil, the heads of the Executive Power must render accounts, referring to the prior fiscal year for the exam of the courts of auditors, who issue their preliminary opinions, and are judged by the Legislative Power. Although the importance of the exam of these accounts is repeatedly exalted, the results of this process frustrate expectations; there is a methodological delay in the activity and limited scientific production about its performance. Such exam is the object of this research, whose objective is to investigate the relationship between the constitutional norms that institute the financial and budgetary accountability system, with respect to the rulers, and the norms of integration of that system. It aims at finding out how the Brazilian Courts of Auditors should examine the accounts rendered by presidents of the Republic, state and federal district governors, and municipal mayors, and whether the infra-constitutional legislation, related to this exam, complies with the constitutional accountability system. Bibliographic and documentary -- mainly legislative research covering national, federal, state and municipal legislation -- research was carried out. To examine the municipal legislation, a representative probabilistic sample of the Brazilian municipalities was selected. This is a normative research, which does not investigate whether the daily practice of assessing the rulers\' accounts complies with what the legislation establishes. The research does not address the judgment of accounts in parliaments, nor the possibility of impugnation in the Judiciary Power. No historiographical or comparative research was performed. As a contribution to the legal science, it is demonstrated how the financial and budgetary accountability system, was established by the Brazilian Constitution of 1988, requiring that the accounts of the presidents, governors and mayors have to be rendered and examined. It is also demonstrated that, in many relevant issues, the normative set does not meet the requirements stipulated by the constitutional basic structure, in some cases by omission of the infra-constitutional legislator, and in other cases because the imposed rules are in direct disagreement with the constitutional system. Finally, the research shows how to correct the legislation and address legislative omissions. Thus, the work can refine the normative set and qualify the exam of the accounts rendered by the heads of the Executive Power. Therefore, the presented contributions help to strengthen the horizontal and vertical accountability in the country and, consequently, to improve the Brazilian representative democracy
