Female incarceration in Brazil: between gender particularities and the unconstitutional state of things

This paper seeks to analyze the historical and sociological aspects of gender inequality, going through the oppression experienced by women in society and their consequent insertion into criminal conduct, demonstrating how the peculiarities of gender function as a form of violence behind bars. This analysis will have as background the unconstitutional state of things, in which the Supreme Federal Court recognized, through ADPF 347/DF, that the Brazilian prison system is crossed by systematic violations of human rights. For this, the research will evoke human and fundamental rights, both nationally and internationally, in addition to judgments and legislation relevant to the theme to be developed in order to understand how the typical needs of women are met within the prison system.Pesquisa sem auxílio de agências de fomentoTrabalho de Conclusão de Curso (Graduação)O presente trabalho busca analisar os aspectos históricos e sociológicos da desigualdade de gênero, perpassando pela opressão vivenciada pela mulher na sociedade e sua consequente inserção em condutas criminosas, demonstrando como as peculiaridades do gênero funcionam como uma forma de violência atrás das grades. Tal análise terá como plano de fundo o Estado de Coisas Inconstitucional, no qual o STF reconheceu, através da ADPF 347/DF, que o sistema penitenciário brasileiro é atravessado por violações sistemáticas dos Direitos Humanos. Para isso, a pesquisa evocará direitos humanos e fundamentais, tanto do plano nacional, quanto internacional, além de julgados e legislação pertinente com a temática a ser desenvolvida a fim de entender como as necessidades típicas da mulher são atendidas no âmbito do sistema prisional
