User-Generated Content Challenging Copyright Law : Change in the Balance of Interests in the Interpretation of the Three-Step Test

Copyright is used as a tool of public policy. Due to this role copyright is not absolute and unlimited, but rather subject to exceptions and limitations that are used to balance the interests of right holders and the users of creative work. The three-step test is used to determine if national exception or limitation to copyright is acceptable. The test has three requirements which national exception or limitation to the exclusive right has to satisfy: it is limited to certain special cases, it does not conflict with normal exploitation of the work and it does not cause unreasonable prejudice to the legitimate interests of the right holder. The test has been interpreted on the international level only once by the World Trade Organization (WTO) Dispute-Settlement Panel, and this interpretation indicates that the interests of the right holder, especially economic ones, should be favored over the interests of the general public. This imbalance of interests seems to be shifting towards actual balance of interests. This study is conducted by analyzing the relevant international conventions related to the interpretation of the three-step test and freedom of expression. This study also utilizes a wide range of scholarly material, especially when assessing the proposed future of the interpretation of the test. The Declaration on a balanced interpretation of “the three-step test” in copyright law is one of the most important sources of this study, together with writings of Martin Senftleben, Daniel Gervais and Cristophe Geiger. The focus of this study is on the shift in the balance of interests and the struggles the copyright system faces due to technological development. The development allows general public to participate to the creation and dissemination of the content they consume. This user-generated content is challenging the current copyright system and the interpretation of the three-step test. This study finds that how user-generated content is treated and what kind of exceptions and limitations are drafted to regulate this activity has a direct impact not only to the interests of the right holders of copyright, but also to the freedom of expression. This study finds that the current, restrictive style of interpretation of the three-step is not a viable solution in digital era. If the criteria set by the WTO panel would be followed, finding a true balance of interests through a copyright limitation or exception allowing the dissemination and creation of user- generated content would not be possible. This study concludes that the most favorable approach would be a comprehensive overall assessment of the three-step test.Tekijänoikeutta käytetään julkisen vallan välineenä eikä se siten ole absoluuttinen ja rajoittamaton oikeus. Tekijänoikeus on rajoitusten ja poikkeusten kohteena, joita käytetään pyrittäessä löytämään tasapaino oikeudenhaltijan ja luovan työn tuotteiden käyttäjien intressien välille. Kolmen kohdan testiä käytetään määrittelemään onko kansallinen tekijänoikeutta rajoittava säännös hyväksyttävä. Täyttääkseen testin vaatimukset rajoittava säännös saa koskea vain erityistapauksia, se ei saa olla ristiriidassa teoksen tavanomaisen hyödyntämisen kanssa, eikä se saa kohtuuttomasti haitata oikeudenhaltijan oikeutettua etua. Testiä on tulkittu kansainvälisellä tasolla vain kerran Maailman kauppajärjestön (WTO) riidanratkaisupaneelin toimesta. WTO:n paneelin tulkinta osoittaa, että oikeuden haltijoiden intressejä, etenkin taloudellisia, suositaan suuren yleisön intressien kustannuksella. Intressien epätasapaino näyttää olevan korjaantumassa. Tutkimus tehdään analysoimalla keskeisiä kansainvälisiä kolmen kohdan testiin liittyviä sopimuksia ja ihmisoikeussopimuksia. Tutkimuksessa hyödynnetään laajalti myös oikeuskirjallisuutta etenkin arvioitaessa testin tulkinnan tulevaisuutta. Tutkimuksessa keskitytään intressien tasapainon muutokseen ja teknologisen kehityksen tekijänoikeusjärjestelmälle aiheuttamiin haasteisiin. Teknologinen kehitys mahdollistaa tavallisten ihmisten osallistumisen sen sisällön tuottamiseen ja jakamiseen, jota he kuluttavat. Käyttäjien luoma sisältö haastaa tekijänoikeusjärjestelmää ja kolmen kohdan testin nykyistä tulkintaa. Tutkimuksessa todetaan, että tekijänoikeuden haltijoiden intresseihin ja sananvapauteen vaikuttaa se, miten käyttäjien luoma sisältö nähdään ja minkälaisia rajoituksia sen käyttöön kohdennetaan. Tutkimuksessa todetaan, että nykyinen, rajoittava tulkinta kolmen kohdan testistä ei ole soveltuva ratkaisu digiajalla. WTO:n paneelin tulkinnan mukaan tekijänoikeutta ei voisi rajoittaa sallimalla käyttäjien luoma sisältö ja sen jakaminen. Näin ollen todellista intressien tasapainoa ei saavutettaisi.
