Anterioridade Eleitoral E Segurança Jurídica

The lack of legal certainty is one of the major concerns of Law, mainly of Procedural Law. The same happens with Electoral Law and Electoral Procedural Law. To minimize the lack of legal certainty and to avoid casuism, the Brazilian Constitution provides the electoral annuity rule. However, even a rule that aims to provide legal certainty becomes victim of insecurity when it is interpreted by the Courts. So, in order to develop the Electoral Procedural Law, it becomes necessary to study the legal certainty and the electoral annuity rule. Keywords: Electoral Law. Electoral Procedural Law. O mesmo ocorre com o Direito Eleitoral e o Direito Processual Eleitoral. Para que se diminua a insegurança jurídica e sejam evitados casuísmos, a Constituição da República Federativa do Brasil prevê a regra da anterioridade eleitoral. Contudo, mesmo uma regra que tem por finalidade dar segurança jurídica acaba sendo alvo de insegurança quando da sua interpretação. Assim, para que o Direito Processual Eleitoral evolua, faz-se necessário o estudo da segurança jurídica e da anterioridade eleitoral
